theyre not statues theyre digital promotional artwork thats been floating around for a while. theyve been using them for stupid things like crappy posters youd buy at walmart.

I would since Nolan said he thought it would be disrespectful to Ledger.

If Nolan were just lying to keep the surprise, he would have just said something like "No, Joker played his part and we're moving on to something else now." I wouldn't have thought it disrespectful to recast or use the Joker in some small way, but after knowing Nolan said it would be disrespectful, if he actually did do it, I would be kind of offended.
