It's not too much of a jump. She was over a year old in the pilot and now it's season 3, so her being 3-4 is not out of the question.

'Modern Family' Cast Sues 20th TV as Contract Renegotiation Turns Ugly (Exclusive)

The cast of Modern Family has declared war on producer 20th Century Fox Television.

Sources tell The Hollywood Reporter that cast members Ty Burrell, Julie Bowen, Jesse Tyler Ferguson, Eric Stonestreet and Sofia Vergara have filed suit today in Los Angeles Superior Court to void their contracts. The legal theory, according to sources who have seen the lawsuit, is that their deals violate California's "7 Year Rule," which prohibits personal services contracts for longer than 7 years. This tactic is a common one for actors who seek to void contracts during renegotiations for increased compensation.

The move comes amid a salary standoff that has already delayed today's scheduled table read that would have marked the start of the fourth season of Modern Family, one of TV's top-rated comedies. The cast, minus Ed O'Neill, who is paid more than his co-stars and is negotiating separately, has hired litigator Jeff McFarland with LA's Quinn Emanuel firm and are pressing their case in court.

UPDATE: A source close to the negotiations tells THR that O'Neill has decided to join his castmembers as a plaintiff in the lawsuit. O'Neill has his own salary beef with 20th TV but he is paid on a different track and was thus not involved in the original plans to sue. Yet O'Neill is said to want to join the suit out of solidarity with his cast, and once he is officially signed as a client by litigator McFarland, the suit will be amended to add O'Neill, according to sources.


The six adult cast members currently have contracts through the seventh season of the show. But as THR previously reported, renegotiations are common between the third and fourth seasons, when casts of hit shows typically get bigger paychecks in exchange for agreeing to continue with the show beyond the seventh season. Sources tell THR the five cast members are being offered salary increases as follows: $150,000 per episode plus a $50,000 per episode bonus for season 4; $200,000 per episode for season 5; $225,000 for season 6; and up to $325,000 for an anticipated season 9. The cast is asking for much more, including more than double the offered salary if the show goes 8 or 9 seasons, as expected.

A rep for 20th TV declined to comment.

With the exception of O’Neill (Married… with Children), the actors were paid in the $65,000-an-episode range for the show’s 22-episode third season, according to sources. O’Neill is believed to have made in the $105,000 range this past year.

The series is a profit center for both the studio and the network, regularly drawing 13.1 million viewers, according to Nielsen. In 2011, Modern Family generated $164 million in advertising revenue for ABC, up 40 percent from a year earlier, reports Kantar Media. What’s more, the multiple Emmy-winning series*has proved an American Idol-style launching pad for the network’s other comedies, including Happy Endings, Don’t Trust the B---- in Apartment 23 and the upcoming alien effort The Neighbors.

Coming out of its breakout freshman season in 2010, 20th TV inked a rich syndication deal with USA –the NBCUniversal-owned cable network’s first major comedy acquisition—for a license fee close to $1.5 million an episode, say sources. That’s roughly on par with the deal Turner’s TBS struck with Warner Bros. TV for repeats of The Big Bang Theory. Modern Family is poised to reap many more millions from broadcast stations when the series rolls out in syndication in 2013, and foreign revenue is said to be particularly robust.

Wow, they were only getting 65k? And yes, they make more in 1 episode than regular people in a year but you have to remember how much money the show is making for ABC. I hate when people complain about celebs complaining about money. Modern Family did $140 million in advertising alone and the stars are getting 65,000 an episode. That certainly isn't fair by any means.

Yeah but these contracts would've been signed before the show even aired.
They had no way of knowing if would be hit it is. So because it is a hit, the network made a lot of money and the cast wants their slice of the cake too.

If it had been a flop, the network would've lost money, cancelled it and the cast would've been looking for new jobs.

But we all know how it's going to end. The TV company will break down and pay the actors. Meaning or saying if you hold out or complain enough you'll give your way or what you want like a little kid.

The cast of Big Bang Theory which is in the same playing field as Modern Family in terms of awards and ratings...they are getting like 400,000 an episode I think. So I would surely be upset if I was only getting 65,000 for doing the same work.

The six adult actors will get major raises from studio 20th Television and drop their lawsuit as one of TV's most contentious contract negotiations comes to a close.

The Modern Family cast has resolved a major family feud.

After a summer of heated salary negotiations that led to a lawsuit, the cancellation (and subsequent rescheduling) of a table read and a tense week of back-and-forth negotiations, the six adult actors on ABC's top-rated comedy have agreed in principle to new contracts with producer 20th Century Fox Television.

According to sources close to the negotiations, the deals for Julie Bowen, Ty Burrell, Jesse Tyler Ferguson, Eric Stonestreet and Sofia Vergara will provide for substantial raises over the castmembers' current salaries of about $65,000 per episode (Ed O'Neill made about $105,000 for season three) to more than the $150,000 for the upcoming fourth season that Fox offered on Monday. Significantly, sources say all cast members will now receive a cut of the show's back-end profits (a perk the non-O'Neill cast members did not previously enjoy).

In exchange for the increased salaries, sources say the cast members have agreed to add one year to their existing seven-season contracts and to drop the lawsuit filed Tuesday in Los Angeles Superior Court. That suit sought to void the castmembers' existing contracts due to an alleged violation of California law prohibiting personal services contracts that last longer than seven years.

The deal allows the fourth season of the Emmy-winning comedy to begin production on time next week in advance of its Sept. 26 premiere. The series is a profit center for both 20th TV and ABC, for which it regularly draws 13.1 million viewers, according to Nielsen. "It's no surprise, but I'm of course thrilled and I cannot wait to get on stage Monday morning and start making the show again," co-creator Steve Levitan tells The Hollywood Reporter. I'm very happy for my friends on the cast for their success, I really am."

"I'm thrilled," adds co-creator Christopher Lloyd. "It was a distraction more than anything. And I think the cast feels the same way. It was never arduous. Now other people can go on with the numbers and we'll go on with the letters."

They definitely deserved the raise. With the amount of $ ABC was raking in, yeah, they were due for raises. The lawsuit wasn't anything out of the ordinary really. If a show becomes a hit, no actors in their right mind would be ok with staying at their starting salary for the duration of the show. It'd be like starting a job and never asking for a raise when year after year they don't give you one.

Hope the kids get a little more $ thrown their way too.
