These union rules might not apply to independent films, such as those from Korine. Korine isn't exactly a major studio guy.

If there weren't union regulations for tobacco use the entire cast of Mad Men would be dead by now.

I really have no idea what they used to imitate the smoke in this film but I wouldn't be surprised if they used the real thing.
