I smell bullshit, and it isn't even April. King Kong is most certainly not in the public domain. How many SyFy Original Kong movies would we have if that were true? King Kong vs. Sharknado, anyone?
Universal owns Kong. WB only has a stake in Legendary's Godzilla 2 (and presumably, Pacific Rim 2) because they did the original installments with Legendary. Legendary couldn't move Batman and Superman to Universal, and they can't move Kong to WB. Of course it's *possible* copious amounts of cash are changing hands to make this happen, but I highly doubt it.
