No one knows for sure who isn't party to it
Rumor has it either in January, or when they released 100 discs(which they now have).
Either way, I expect them to go neutral at CES 2008, that way they can look like they stayed loyal to Toshiba as long as they possibly could, but that Toshiba just couldn't hold up their initial promise.
