I took this to mean the company wouldn't sell it to Netflix for next to nothing so Netflix took a page from the Walmart book of monopoly marketing and said to hell with you. Naturally, smaller distributors can't afford to make the sort of price concessions that larger companies do so the Criterions of the world will suffer. This is yet another example of how Netflix isn't reacting to the market (as they claim) so much as directing it.

There are tons that are unavailable on Blu-ray and it been going on for a while now.

It frustrates me because I want to see them BEFORE buying them to be safe.
