The GLADIATOR fiasco was exposed after release, and it was easier for the studio to acknowledge (to some extent) and implement a replacement program for a product that by then was already distributed and sold, and only for those who expressly asked for it. But if Warner were to acknowledge any flaw with this transfer now, before release date, they couldn't put out the actual product on the shelves and would have to recall all copies, after having spend quite some money on distribution (by now, most retailers have their copies stored).
Since, as has been said here several times, most buyers won't see a problem with their discs, it makes more sense to remain quiet for now, sell it like it is, and then issue some official statement on the matter and offer a replacement at a later time, likely several months down the road, to save face.
Then again, all this is pure speculation on my part with no real evidence to support it, and it well may be an educated guess or simply wishful thinking.
