Default Store Return?

I have an xbox 360 and the other night i got the ring of death so i need to get a new system. i bought it last year in april and i got an extended warranty from circuit city.
now can i exchange it for a new one or do i send it to microsoft and they send me a new one. and if circuitcity will give me a new one will i have to give the Hard drive back too, because i bought the premium but i have a lot of downloaded content on the hard drive and i want to keep it.
also if circuit city does give me a new premium 360 which is worth $400 dollars can i pay an extra $80 dollars and get the elite which is $480 dollars or do i have to just get the premium.

Same thing happen to my son's 360. I had to send it to Microsoft and they sent me back a refurbished 360. I was so mad. 2 months later the refurbished one got the 3 rings of death. I called Microsoft and they said to send it and they will again send a refurbished one. I said hell no, I'm not going through this again and decided to buy a new one. No problems with the new one.
Microsoft sucks.

Typically Circuit City's plans require you to send them the console, and all that came with it, to them. Once they receive it they then verify that the console is dead and then and only then do they send you a voucher for the purchase price plus tax of what you paid for it.

DO NOT send it to Microsoft for a Circuit City Extended Warranty since it is out of the manufacturers warranty.

If it is still under CC warranty you will just get a new one.

i really dont want to give everything back.. cant i say that i had traded my hard drive in or sold it to someone... and my system still turns on and it works for about 10-15 minutes and then shuts off and shows the ring of death
so can i just say i dont have the HDD and no one answered my question about paying the extra 80 for the elite
