Default How to deal with Ebay refund request?

Hi. I'm not sure if this goes here. But, I sold a brand new movie I bought personally at the store and sold it on Ebay. I never opened it and mailed it with the original plastic wrap still on. It is a Interstellar Neo Pack from Walmart. The buyer is claiming is is not new and has fingerprints on the disc. How is that even possible if it was still in the plastic wrap when I mailed it? Now they are requesting a refund for what I think is a scam. What should I do?

Have them mail it back before you refund money. Not much you can do. eBay would probably side with the buyer.

Fixed your assessment of what eBay will do EVERY time in this case.
The seller got scammed, they watched the movie, thought it sucked and want their money back. Now you most likely get to pay return shipping on top of giving him the privilege of watching the movie. Oh and now your once sealed movie is worth less when you try and sell it again.

And now the seller will also have a "defect" on your eBay account.

Welcome to the wonderful world of being an eBay seller.

Thanks for the feedback friends. I am just going to refund the seller and take the loss. I have a perfect rating with over 300 transactions. I wonder if he has a Interstellar Neo Case and was fishing for a Imax Film Cell that sells for a pretty penny?

I don;t know how it happens -- a glitch in the assembly line where a worker has to intervene or repack an item for some reason, random inspection off the assembly line, bad luck. Unfortunately I've never seen many of the production lines in action to know what steps are involved and at what point humans will be or can be involved.

Sometimes they are repackaged by teh retailer for various reasons.

I know many of the Criterion Dressed to Kill cases were opened to replace the defective 1st pressing with the corrected 2nd pressing. They kept the cover art with the 1st Pressing lable then resealed it with a different shrink wrap than Criterion was using at that time. I had couple smudges on mine once I opened it.
Yep, I've had this happen a number of times too. Factory sealed, I'm pretty sure not resealed since they had the MADE IN MEXICO stamp on the shrink wrap, but when I opened it up there are finger prints on the disc.

In fact I just saw this on one of the Target Bourne SBs that I've had for ages and only recently opened up since we went on a Bourne watching spree and one of the movies had fingerprints all over it. Just wiped them off and it was fine, but it does happen from time to time.

Wrong!

The seller does not have to pay for the cost of shipping the item back to them. That is the responsibility of the buyer requesting the refund.

Also, the buyer must be able to provide a tracking number to prove that they sent the item back to the seller.

In this case, the seller should simply state that they are willing to provide the refund once the item is sent back to them. Once the buyer realizes how much cost and effort will go into sending the item back to the seller with a tracking number if it is indeed somebody trying to pull a scam, they'll probably realize it's not worth the bother.

If the buyer claims the item is "not as described" the seller pays. It's pretty black and white. The seller can either voluntarily send the buyer opening the claim a pre-paid label or eBay will send it to the buyer and simply add the cost to your monthly eBay invoice.

The buyer isn't just saying he wants to return something because he changed his mind. Buyer is claiming the item was not new and was used, aka Not as Described.

Ironically my brother purchased a gift card from an individual this past week that was empty. Seller balked at him returning, he opened a Not as Described case with eBay. He had to wait a few days but once the wait period was over today eBay decided in his favor in under 5 minutes.

Details:
Decision:
This case has been decided in your favor.

Comments:
You must send the item back to the seller by Apr 11, 2016 to be eligible to receive a refund. You can either print the label on eBay from the Resolution Center or use your own label and submit the tracking information in your case in the Resolution Center. If you use your own label, you may not be reimbursed for the return shipping. Once the item has been returned to the seller, you will be issued a refund. The seller's shipping address and shipping instructions are available in the Resolution Center. Please remember to submit your tracking information by Apr 11, 2016.

Never take the loss. If you have proof of purchase, even a bank statement or credit card record of the purchase you won't lose your money. If you had clear item pictures you won't lose your money either. If you don't have any of that you need to fight to keep your money. Use logic, call Ebay if you want, etc. If you feel like you really are going to lose then you just cuss out the buyer and customer service multiple times. Drink beer and smash cans on your head. Break glass things, etc. Mail the guy dog turds. Start WWIII. Never give in.
