Default Court case to impact future legality of dvd and Blu-ray backups

http://www.pcworld.com/article/16382...ould_care.html

The legality of RealNetworks' dvd-ripping software is being fought over in U.S. District Court. The decision will likely have implications for Blu-ray ripping software.

But if a company that makes this software is not in the U.S, then I don't think there is anything that can be done.

This case doesn't just sound like DVD backups being legal vs illegal.

Sounds more like Real Networks (possibly) improperly used the CSS license they were given.

Shouldn't stop people from cracking copy protection and creating programs for creating DVD or Blu-ray backups.

Just because people can do illegal things with something, doesn't make that something illegal. Look at so many things in everyday life for proof of that. I mean look how many illegal things you can do with a car, but they still seem to be legal don't they.

Hell, look at the CSS license itself. If someone can use that to help them create DVD backup software, than the CSS license itself should be just as illegal as the program created with it.

I know I'm obviously not necessarily comparing apples to apples (it's really more just wishful thinking on my part on how I wish things worked), but I hate DRM and copy protection. It's a pain in the normal consumers behind and it doesn't really prevent anything. If companies stopped wasting money (and I'm sure it's a lot) on all this protection stuff, they could afford to simply lower the price of the product itself and more people would buy it.

If DVD or BD ripping is illegal, does that mean CD ripping is illegal?

I remember 321 Studios and their DVD X software, which the studios shut down in court. Not before said 321 studios released a bunch of Platinum editions of their DVD copying software, which were full of bugs.

Ripping any type of disk is not illegal if you only intend to use it yourself. As soon as you pass it on to someone else then it becomes an illegal act.

so why are CD's so easy to copy with Nero. but DVD's are not. if both are Illegal. CD's should be as hard to copy as a DVD's.

When the redbook cd format was invented, no one had ever really imagined wide-scale digital piracy by consumers, so the music labels did not think to attempt to "lock" down the format. In hindsight the labels would have done the same thing the movie studios attempted with their formats if they had foreseen things like Napster and Nero.

DVD's are just as easy to copy with the right software. Just go on any torrent site and you can find rips of almost any film. I will not admit to doing this as I do not want a knock on the door at 3 in the morning.

Have to agree 100% with this statement. With the advent of widely used personal computers any format is going to be ripped. Any code the studios use will be broken within days by the hackers. The only way to stop this happening in my view is to bring the price of films and music down drastically, but this will never happen.

I think its not only the issue of making backups legal or not
when the dvd x copy introduced the hollywood didn't give it up on the backups.
especially dvd x copy embeded their logo in the disc. since then how many softwares poped up in the market and on internet and 90% of the softwares doesn't embeded their logo

same thing with bluray let say some corporate released the software with the logo in the begining of the disc
hollywood would do the same thing
what do u guys say....!!!!!!!
