Every time that Criterion has announced a title going Out Of Print, they've stated that copies will be available until a specific date (always the last day of whichever month they make the announcement) while supplies last. After that date, they can't sell them. Here is an example of one such announcement. Note that it doesn't say they won't be producing any new copies after that date, but that they will be selling copies only through that date.

And Criterion frequently sells titles after the rights are lapsed. The difference being that these particular titles probably had 100x as many copies pressed as the ones that quickly sell out.

Name one. Aside from a title that's available only as part of a boxed set (which is clearly a special circumstance, and even then, most of their boxed sets go OOP when they lose the rights to any of the films in it).

I assure you: if Criterion has a warehouse full of unsold Armageddon discs from 15 years ago nobody at Disney is trying to stop them from selling them.

And it may well be the case, but you can't assure anyone of it unless you actually know how many copies were pressed and how many are left.

And Disney may well not care that Criterion is still selling copies, but that still constitutes a permission. Who knows, maybe the original contract allowed Criterion to have copies pressed until a certain date, and then allow Criterion to keep selling any copies they have on hand after that date. If so, it's still a contractual agreement.

I mean, seriously? Disney is more vehement than any other media company on the planet in making sure that no one violates the rights of any of their properties. If they didn't want Criterion to continue to sell copies, then Criterion wouldn't be selling them. Period. That Criterion is still selling them means that it's OK with Disney. That constitutes an agreement, even if all it consists of is Disney saying, "Yeah, sure, go ahead and sell them; we don't care."

I would have released this on Blu, but the DVD sales where so-so so unless I do a limited edition Blu, I wont be releasing it on Blu in the near future.
