Every time that Criterion has announced a title going Out Of Print, they've stated that copies will be available until a specific date (always the last day of whichever month they make the announcement) while supplies last. After that date, they can't sell them. Here is an example of one such announcement. That constitutes an agreement, even if all it consists of is Disney saying, "Yeah, sure, go ahead and sell them; we don't care."
