We know that the first movie includes Riddles in the Dark (both for chronological and marketing reasons--Have to get as many LOTR-franchise callback characters into the first movie as possible, Gollum included)--
Where, as Bored of the Rings put it, "(Bilbo), having conveniently developed amnesia that his companions were being turned to chutney outside the cave, accepted the challenge".

I'm assuming that's going to constitute most of the climax of the first movie, as they're keeping the new LOTR-integrated focus on "Prequel of the Ring"--What with Gandalf's new side trips, and Galadriel's unexplained appearance in the story, and all.

In the complaint (read it here), the Tolkien Estate Ltd, its trustees and News Corp-owned publisher HarperCollins have charged the studio, its New Line subsidiary and The Saul Zaentz Company’s Middle-earth Enterprises division with copyright infringement and breach of contract. It’s not the hugely successful movies they’re fighting over this time. Now its merchandising that the Estate says was never anticipated as part of its original 1969 deal with the studio and rights holder Zaentz. “The original contracting parties thus contemplated a limited grant of the right to sell consumer products of the type regularly merchandised at the time (such as figurines, tableware, stationery items, clothing and the like). They did not include any grant of exploitations such as electronic or digital rights, rights in media yet to be devised or other intangibles such as rights in services,” says the 26-page complaint. This legal move comes just under a month before the Warner Bros-distributed and Peter Jackson-directed The Hobbit hits the big screen on December 14. The Lord Of The Rings trilogy, directed by Jackson, has made almost $3 billion in worldwide box office.

“Not only are gambling services outside the rights granted, but this exploitation of Tolkien’s well-loved work has offended and distressed Tolkien’s devoted fans, harming Tolkien’s legacy and reputation,” The Tolkien Estate said in a separate statement to Deadline. “The plaintiffs have been compelled to take this action to protect their literary and commercial assets and hope that the dispute will be resolved quickly,” the Estate and the publisher added. The Tolkien Estate and HarperCollins, who filed their complaint in federal court in LA on Monday, have requested a jury trial for their claims. Warner Bros had no comment on the suit. This isn’t the Tolkiens and Warner Bros’ first court battle. In 2009, the Tolkien Estate and New Line came to an out-of-court settlement after the Estate sued had the studio over profits from The Lord of the Rings movies the year before. That settlement paved the way for Warner Bros to make more Tolkien movies like the upcoming Hobbit.Bonnie Eskenazi, Ricardo Cestero and Elisabeth Moriarty of LA firm Greenberg Glusker represent the plaintiffs in this latest suit.

The group reiterated that it only monitors animal use on set, and that the incidents in question happened at a working farm 186 miles from the main set and 26 miles from the soundstage. “We do not have either the jurisdiction or funding to extend that oversight to activities or conditions off set or before animals come under our protection”, said AHA president and CEO Robin Ganzert. “There are too many incidents off the set and this must stop. It is vital that we work with the industry to bring the kind of protection we have for animals during filming to all phases of production.” The AHA said it sent letters to industry leaders in January of this year seeking ways to work together to improve the welfare of animals off the set as well as on.


PREVIOUS, 11:17 AM: Producers of Warner Bros‘ trilogy The Hobbit said today that they “completely reject the accusations that 27 animals died due to mistreatment during the making of the films”. In a statement, director Peter Jackson and other producers of the upcoming JRR Tolkien films say claims by dismissed animal wranglers that sinkholes and other death traps led to more than two dozen animal deaths on a farm where they were stabled and housed are false. The accusations were brought to light in a Associated Press report today based on information that rights group People For the Ethical Treatment of Animals claims it provided to the news agency. Here’s the producers’ statement:

The producers of The Hobbit take the welfare of all animals very seriously and have always pursued the highest standard of care for animals in their charge. Any incidents that occurred that were brought to their attention as regards to this care were immediately investigated and appropriate action taken. This includes hundreds of thousands of dollars that were spent on upgrading housing and stable facilities in early 2011.

The producers completely reject the accusations that twenty seven animals died due to mistreatment during the making of the films. Extraordinary measures were taken to make sure that animals were not used during action sequences or any other sequence that might create undue stress for the animals involved. Over fifty five per cent of all shots using animals in The Hobbit are in fact computer generated; this includes horses, ponies, rabbits, hedgehogs, birds, deer, elk, mice, wild boars, and wolves.

The American Humane Association (AHA) was on hand to monitor all use of animals by the production. No animals died or were harmed on set during filming.

We regret that some of these accusations by wranglers who were dismissed from the film over a year ago are only now being brought to our attention. We are currently investigating these new allegations and are attempting to speak with all parties involved to establish the truth.
A decade ago there were accusations, later found to be false by New Zealand officials, that horses were abused during the making of Jackson’s Lord Of The Rings films. The American Humane Association told the AP today that they knew of no animals being harmed during the filming of The Hobbit: An Unexpected Journey — the first film in the trilogy that opens December 14 — but that it had no oversight over the facilities where animals were kept — on a property outside Wellington, New Zealand. The Hobbit films were shot in New Zealand and the UK.

The Appendices should have been part of Lord of the rings (movies) and not the hobbit. LOTR is six books if you include the Appendices .

It's just a publicity stunt by PETA,isn't it? What a coincidence to bring this up just before the movie gets released.....

I find it fascinating though how these movies seem to attract legal and other troubles like flies attract s...

However I'm in no doubt that these will be a box office triumph and great movies to boot.

Every trailer I've seen I just feel like meh looking at the actors, the bars so high from the LoTR I doubt these actors can keep up.

Exactly - they hurt their cause more than support by just doing stupid things. There isn't a Hollywood studio or producer that would allow any animal cruelty on or off sets these days, because they wouldn't risk the backlash from an organisation such as PETA postponing release of the film.

I agree with PETA in that animals shouldn't suffer cruelty ever, especially for entertainment purposes, but they really do go the wrong way with how they get their name in the media.

So this is one of the many hilarious things urban dictionary has for hobbit

hobbit:
an unknown person who stays in your home for extended periods of time and doesn't respond to hints that they should leave.

Example:
"dude the hobbit is sleeping in my bed and know I have to sleep on the coach," "damn the hobbit is back I thought it was finally over," "I think the hobbit came onto me and it is getting awkward."

How about that it appears that more than 50% of this first film takes place in 'Goblin Town'?

New title: An Unexpected Journey to Goblin Town.

However as I said before, STING is looking a thousand times better then it appeared in the LotRs films.
