The man’s attorney says they are suing the governor and this could be the first of many lawsuits of this kind. Attorney Blair Dunn says his client, Madux Hobbs, is the owner of two restaurants, a catering business, and a couple of vacation rental properties in Roswell.

Dunn says all four of Hobbs’ businesses have suffered over the past few months because of the governor’s public health restrictions. Dunn says the 14-day quarantine for out-of-state visitors has discouraged travelers from coming to New Mexico, slowing down business for Hobbs’ vacation rental properties.

“It’s hard to go some place when you can’t really get out to eat much, you can’t do much when you’re out and about. Everything’s closed down,” says Dunn.

That’s why Hobbs is suing the state, including Governor Michelle Lujan Grisham and Health Secretary Kathy Kunkel. In the lawsuit, Hobbs claims if the government is going to shut down his businesses, then they should be paying him for all the revenue he has lost during this time.

Dunn did say Hobbs filed for small business loans, but that only covered rent and wages for his employees. Hobbs relies on the revenue from his businesses to support his family.

KRQE News 13 reached out to the governor’s office for comment, but haven’t heard back. When she was asked about her decision to restrict indoor dining again, earlier this month, the governor acknowledged restaurants are not at fault, but she said the restrictions are necessary to save the lives of New Mexicans.

I'm sorry, but this is off topic. But I can't help but notice the footwear on a lot of those people in that picture. Many are wearing flip flops and Birkenstocks and one person there is wearing some sort of thick sole sandal! Do people not realize how much walking is required at Disney World? People should be wearing athletic shoes to Disney World and nothing else.

I tell you what folks both of my nostrils still not feeling good esp my right side after swab yesterday eh It did help get stuff out left side when I blew my nose when got home at least I didn't have to the swab mouth part meh

Drivers are straight up brazen now in Los Angeles, not even counting the seemingly nightly car chases on tv. I haven't honked at anyone in years.

Maybe. There will always be problematic people (if that was not the case this would not be a problem any longer), but what I meant was I can easily see the difference between making them mandatory and not.

I think the biggest difference is timing. That is what makes this things so difficult. Opening or closing stuff up won't affect the numbers the same day circumstances change, you won't see it in the next week, it takes a month or two for sick and an other month or two for deaths to follow the new "wave".

for those of us dealing day-to-day with the stress of the pandemic, especially with direct experience, be it thru family/friends –

I wish there was a way to help restaurant and bar business owners and the staff directly with the government funding. I would prefer that to a 2nd check made out to me. With our current actions trying to hold R at 1 its kind of a waste of money trying to even save restaurants. If anything has been shown by americas strategy its that partial shutdowns with massive numbers of exceptions are not very effective. like with the current restrictions our best case scenario is stop growth at like 80k sick a day.

Personally I think you need to shut down nearly everything for a couple of weeks to achieve an R of around .3 like the chinese. with a harsh lockdown enforcement is possible and the shutdowns last weeks rather then years (at our current level of lockdown heard immunity will take around 3 to 4 years for the country).

I completely agree. I am totally in favor of a total lockdown for a short time rather than endless “soft” lockdown and roller coaster reopening. Sadly the name of the game is compromise. Without being specific, for the sake of the rules of the thread, I feel a vocal portion of many communities will resist anything that strict 4 months after the start of the initial pandemic shutdowns. We missed our window to crush the curve.

A bar (Brik) on Steinway st. in Astoria has been temporarily suspended now. I'm sure more suspensions are coming.
