She's probably got a new dad by now. No way his g/f was sticking by him now that there was no money coming in and he's in prison for life.

In a weird twist Hernandez's murder conviction is likely to get tossed due to his death. From what I'm reading it is common practice for a murder conviction to simply be voided in Massachusetts if a convicted killer died while appealing the conviction.

Wow I wonder if he did it for that reason.

I read this insane.

Hernandez was still in the process of appealing his 2014 conviction of murdering Odin Lloyd, which means a legal principle dating back to English common law called “abatement ab initio” applies to his case. “Ab initio” translates to “from the beginning” and chief legal counsel to the Massachusetts Bar Association Michael Healy told the Boston Globe that the principle reverts a case to its start if the convicted party dies before the appeals process has concluded.

Healy said that civil proceedings in other cases involving the death of the convicted party were complicated because evidence established in the criminal trial cannot be used to make the civil case.

“Unfortunately, in the Odin Lloyd matter, for the family, there won’t be any real closure,” Healy said. “Aaron Hernandez will go to his death an innocent man.”

In wake of suicide, Aaron Hernandez conviction will be voided

Quote:
In the eyes of the state of Massachusetts, former Patriots star Aaron Hernandez died an innocent man thanks to an archaic legal principle called “abatement ab initio,” said Martin W. Healy, chief legal counsel to the Massachusetts Bar Association.

Though Hernandez was convicted in 2014 of murdering Odin Lloyd, Hernandez’s appeal was not complete. Abatement ab initio means “from the beginning,” Healy said, and it means that upon a person’s death, if they have not exhausted their legal appeals, their case reverts to its status at the beginning -- it is as if the trial and conviction never happened.

“Unfortunately, in the Odin Lloyd matter, for the family, there won’t be any real closure,” said Healy. “Aaron Hernandez will go to his death an innocent man.”

The principle comes from English common law, Healy said, and is observed by several of the older states in the nation. It rarely comes up in practice, he said, and people forget it exists.

It did come up in the case of John C. Salvi 3d, who was convicted of killing two women in a shooting spree in two reproductive clinics in Brookline in 1994 but died by suicide in his prison cell nine months into his sentence, before his appeals were completed.

In that case, Healy said, abatement ab inition complicated civil proceedings that followed.

The principle also came into play in the case of John Geoghan, the priest convicted sex abuse, who was killed in prison.

The principle means that going forward, no evidence established during Hernandez’s trial can be presented in civil court, Healy said.

In other states that have abandoned abatement ab initio, Healy said, the move came after high profile killers had their histories wiped clean. Healy said he would not be surprised if some lawmaker introduced legislation to change the law.

“In the court of public opinion, Hernandez, Salvi, and Geoghan will be judged accordingly,” said Healy. “But in a court of law, under legal principles, [Hernandez] died an innocent man.”

I would bet he did this for his family cause they will collect the remaining guaranteed money on his contract and his NFL pension. Plus his daughter might get that money they pay NFL children if they die. Not sure.

Something tells me he simply killed himself because he knew he more than likely would not be getting out.

I have a hard time believing he was educated on the Massachusetts Code of Laws.

I think this may be it. He technically died an innocent man due to the conviction being tossed. The Pats are going to be on the hook for his contract as a result it would appear.

I don't know. I'm sure someone could have told him. Seems strange that he would do it now after a few days. I bet he said his final goodbyes over the last few days.

With the amount of death and loss of life surrounding this all, it's very sad. Human life is so precious. So many victims.

Anyone watching the White House press briefing? Gronk just came out and asked Sean Spicer if he needed any help.

I hope she and the mother do live happily ever after, but the fact remains Hernandez will always be her biological father and that just doesn't go away because you have a new father.
Who knows, this all could have long term effects, which would be a shame.
But already this child gets to start life with a slight disadvantage, courtesy of her father's total lack of good decision making.
Nothing infuriates me more when child, who didin't have a say in being brought into a situation like this, have to possibly suffer for the transgressions of their parent(s).

It is possible the Loyd family could go after that money in civil court. I know a pension is protected but that salary he was due may not be.

Call me callous or whatever but frankly I don't care that he killed himself, Stephen A. said it best when he said Hernandez got off easy. But it's a damn shame about his daughter, and shame that the conviction will be abdicated. Victim's family deserves better.

They could but a lawyer said it would be super difficult to win because he would have never officially been charged with the crime and they cannot use any evidence collected because of that. It's like none of it happened he was never arrested, charged or investigated. It's pretty insane.

I really hope the Eagles being interested in Joe Mixon is some sort of predraft smokescreen. If this guy is punching women in college, what the hell do you think he's going to do in the Pros making millions??
This guy has Dallas team leader written all over him!
