That's kind of messed up. The German version is considered to be the "official" version (it was the only version included in the Herzog/Kinski box set). But the individual release (by the same company, Anchor Bay) also included the English version in a 2-disc set. Seems weird they'd only have the rights to one, and it also seems weird they'd withhold that information if they had it.

I'm a big fan of movies, but I don't know a lot of the "behind the scenes" stuff.... So, I was wondering is Scream Factory and Shout Factory the same thing?

Scream is a sub-label of Shout.

Another film that I keep forgetting about is Endless Descent - that hasnt had any disc release
And I would love a blu ray of Invaders from Mars - the remake, and the original as well, but I can SF doing the remake at some point

Has the 1989 'Phantom Of The Opera' with Robert Englund ever been brought up in this thread? Was watching it today and kept thinking how much fun Scream Factory could have with it.

Yes it has. It's be nice if they could get it from MGM, its one of favorites as well.

They have a DVD available and have included it in a few multi-movie packs they released. So they are making some money off of it.

Given their catalog though, I doubt Class Of 1999 is even a blip on their radar.

I've heard it explained that movie rights are often retained as investments. Buy low, then retain until you can sell high; retaining rights until the optimal time to release. For example, Class of 1999 may appeal to only a few fans right now but if the new Robocop remake does well and creates a buzz surrounding science fiction cyborg movies then Class of 1999 might become more of a hot property (even more so if there is a remake). In some cases it's not obvious when, if ever, a high point in demand for a title will come so I think some just end up in "what if" limbo.
