Ebay separate seller/buyer contract question???

Can a seller and buyer enter into a separate agreement with different terms (still via ebay) and have that language be the controlling terms of the sale over ebays policies?

Ex. A seller disclaiming liability once shipped and all risk being passed to the buyer? Obviously the buyer would agree to the terms also.

doesn't matter how you word it unless you have a signed contract
the buyer has three avenues to get his back if hes not happy and there's nothing you can do about it.

And a "signature" can be had in a variety of ways.
