To be honest, when there is a piracy warning there, it is simply that they did not take the time to remove it from a transfer where that warning was part of the encode. In other words, they just took the file, and placed it in Vudu (or Flixster, or wherever). The film transfer (with warning or rating screen) was established as a (computer) file unit, film and warning, at some point in time. To remove the warning before the start of the movie involves effort to make a new file; it's not worth the effort to remove it and make a new file (of that transfer), or they simply did not even look, and inserted that transfer into the system.
