So if the Blu-ray rights are basically with Paramount via Rysher, then Criterion would be able to release it.

I don't know how the rights to the Rysher properties are split up, or if Paramount for sure has the rights to Hard Eight. If Paramount owns it, I wouldn't be surprised to see Olive Films release it on Blu-Ray. I'd love for Criterion to release it, though.
