I'm siding with Filmmaker on this. FiM is a "prestige" brand now, I wouldn't put turning down jobs past them if they deem an underlying source questionable or below their working standards. Reputation is a commodity for businesses - reputable ones, at least. Also, just because it's not specified, doesn't mean it's not happening. This could very well be a fresh scan/new master and not be part of the specs, although that part is less likely to happen. I should think a label would want to advertise that part.
