Where was her Dad during this fiasco? If two boys assaulted my Daughter, she wouldn't be facing jail, I would be. That isn't a threat, just a fact.

"The horse is out of the barn," he said. "Nothing is bringing it back."

The Associated Press does not generally identify victims of sexual assault, but Dietrich and her parents wanted her story to be made public. She gave her account to The Courier-Journal newspaper in a story published Saturday. She has not responded to the AP for comment and her lawyer, Emily Farrar-Crockett of the public defender's juvenile division, did not immediately return telephone calls.

Jeff Dion, deputy executive director of the National Center for Victims of Crime, said victims who feel cheated by the justice system sometimes file civil lawsuits in an effort to get information in the public, but social media has turned that on its head.

"It's all about giving victims a voice," Dion said.

In one day, an online petition on Change.org had garnered 62,000 signatures in support of Dietrich's action.

"When I read it, I was appalled and outraged and thought, `Somebody has to do something about this. Who is going to do something about this?"' said Elizabeth Beier, 22, of Cockeysville, Md., who started the petition even though she doesn't know Deitrich. "Everyone wants this girl to have peace and time to recover and not another trauma like jail time."

Beier said the two women have not spoken, but she congratulated her.

"I think what she did was very brave by coming forward ... and I think a lot of people who may have been victims or survivors of assault and didn't get the justice they deserve probably see themselves in her," she said.

Terry O'Neill, president of the National Organization for Women, said the motion to withdraw the contempt of court charge was "a huge victory not only for Ms. Dietrich, but for women all over the country."

Deitrich told The Courier-Journal that after the sexual assault, the boys posted photos of the attack on the Internet.

"These boys shared the picture of her being raped with their friends and she can't share their names with her Twitter community? That's just crazy," O'Neill said.

The Courier-Journal reported that the boys were charged with first-degree sexual abuse, a felony, and misdemeanor voyeurism, according to information in a court motion the newspaper filed asking Judge Dee McDonald to allow the paper to see motions filed by attorneys for Dietrich.

The teens pleaded guilty to those charges in late June, though Dietrich and her family told the newspaper they were unaware of the plea bargain and recommended sentence until just before it was announced in court. The attack occurred in August 2011.

Dion said the Kentucky law on gag orders in juvenile cases presupposes that information revealed came from reading the court record. In Dietrich's case, he noted, she was the victim, and she had independent knowledge of the crime.

"And I think a restriction or gag order on a victim creates some First Amendment issues," Dion said.

He added that prosecuting a victim "sends a terrible message."

"We created victims' rights out of a recognition that we need victims to come forward in order for our justice system to work," he said. "Really, what do they get for that?"

Chris Klein, an attorney for one of the boys, said publicizing their names may create problems for them in the future.

"There's always that possibility and in any type of scenario like this you run that risk," he said. "Now whether both these boys can overcome those hurdles, it's too early to determine that."

Klein said it's possible, but unlikely, that prosecutors would make the same contempt charge against Dietrich. Both sides will still be bound by the confidentiality of the juvenile court proceedings.

"I think her behavior will dictate whether it's the end of it or not," Klein said. "If all the parties abide by the confidentiality of juvenile court, then I think that's the end of it."

Bill Patteson, a spokesman for the Jefferson County Attorney's office, said he could not comment because of the confidentiality on juvenile cases.

Does anyone really care if their names being public creates problems for them in the future? I don't personally unless it means vigilante justice and I still wouldn't see a problem with that.

That's what happens you know, when you commit crimes. And don't give me that under 18 argument, they're 17. They're old enough to know what they did was wrong. it's not like a 5 year old with a gun or something.

Did they not get tried as adults or something?

So what are those two rapists' names? I can't find their names anywhere online.

Edit: Nevermind. Found them along with photographs (or at least the photographs are supposedly them).

according to the courts, she is a minor as well.

i think those two boys should be branded as sex offenders and be put on the national registry.

who give a damn what it does to their reputation?!

I get your point. She could have been the victim of date rape poison, or ill with some condition, or whatever, and I'm fully aware of that.

I'm just wondering if she's one of those people who stand around yelling about "f***in PARTY" until they are blitzed, and devil take the hindmost. For a 17 year old to imbibe anything to the point of unconsciousness is not good, and if so, her sense of outrage smacks of sensationalism to me. Not that the people who assaulted her are not to blame for committing a crime - they should have helped her, not victimized her.

I just don't see any heroes here.

No matter if she drank herself into a coma... She still has every single right to be outraged and beyond. Rape is rape, and unlike a car accident where liability can be split between parties.... It is ALWAYS 100% the attackers fault.

The Associated Press does not generally identify victims of sexual assault, but Dietrich and her parents wanted her story public. The names of the two attackers have not been disclosed because the case has been handled in juvenile court.

During the hearing, Dietrich said she considered suicide after the assault.

"I was in so much pain, death seemed like a friendly thought to me," she said.

The assault gained public attention when Dietrich tweeted the names of the boys against a judge's orders not to discuss the case. Defense attorneys had asked a judge to consider a contempt charge for Dietrich, but dropped their request.

Juvenile proceedings in Kentucky are normally closed to the public, but The Courier-Journal successfully fought to open the case and the court records.

On Friday, Dietrich read from a statement for more than 15 minutes as her attackers sat at a table, one looking down; the other staring straight ahead. Neither spoke publicly during the proceeding.

Dietrich at times addressed her attackers directly. At other times, her hands visibly shaking, Dietrich faced the judge and unleashed her frustrations about the case.
"I couldn't even cry myself to sleep," Dietrich said. "I hardly got any sleep."
Dietrich said she only wanted an apology and a list of people who were shown the partially-nude photos of her taken the night of the assault.

When she got neither, Dietrich said, she went to the police and filed the criminal case. After that, Dietrich said, the two boys and their families began badmouthing her to friends and family members.

"Not only would you not own up to and admit to your actions, you blamed me," Dietrich said.

Assistant County Attorney Julie Hardesty told Dietrich during closing arguments that she was brave for reporting the attack and going through with the prosecution.
"We have admired your strength and we have admired your poise," Hardesty said.
In interviews with Louisville Metro Police in February, the two boys told detectives that they were drinking with Dietrich and a few other people at her home last August when they were left alone with the heavily intoxicated teen.

They told police they assaulted Dietrich because "we thought it would be funny, but it wasn't."

Chris Klein, the attorney for one of the attackers, read a letter his client wrote, apologizing and acknowledging what he did was wrong.

"I still can't believe I was foolish enough to use such bad judgment," Klein read from the letter.

Both teens were students at the all-boys Trinity High School in Louisville at the time of the assault. Attorneys said both now attend other schools. One of the teens has since moved with his family to a new neighborhood.

David Mejia, the attorney for the other teen, said his client feels bad about the assault, but didn't send the photos to anyone. Since the plea became public, Mejia said, his client has faced death threats.
