When it comes to the current state of smartphones yeah, they kinda did. Apple holds a LOT of patents. Anybody else would also be expected to be recognized and compensated for such patents.

i'm pretty surprised. the only phone in my eyes that was a clear and blatant rip off of the iphone was the galaxy s1. the rest of the phones and tablets are a pretty big stretch if you ask me

eh? we were on our way to phones like that already. apple just sped it up. yeah, samsung are a bunch of morons for copying the iphone so closely with the s1, and completely deserve what they got for that phone. i disagree on stuff after that though. and apple holds a lot of patents they shouldn't have been able to get. the whole patent system is flawed right now, and this verdict will do nothing but continue to stifle innovation. i mean..they have the patent on slide to unlock and pinch to zoom. seriously? software patents are ridiculous.

it doesn't matter if you're pro apple or pro samsung, this is the worst possible outcome for the consumer imo. i expect to see other manufacturers to start settling out of court with apple now. and every phone but the iphone is going to start getting dumber. well, except for windows phone, since microsoft made a deal with apple on those patents. like i said before, samsung ripped off the iphone with their first phone, without a doubt. and they deserve to pay for that. all these software patents everyone is suing everyone over is a bunch of bs. and its doing nothing but hurting all of us.

"Today’s verdict should not be viewed as a win for Apple, but as a loss for the American consumer. It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple’s claims. Samsung will continue to innovate and offer choices for the consumer."

Late in the process yesterday at the Apple v. Samsung trial, when the parties and the judge were reviewing the jury verdict form, Samsung noticed that there were, indeed, inconsistencies in the jury's verdict form, a possibility Samsung anticipated [PDF]. Here's the jury's Amended Verdict Form [PDF], amended to fix the mistakes. Here's the original [PDF]. Here's the note [PDF] the jury sent to the judge when told to fix the inconsistencies. What are they, they asked? "Please let the jury know," they wrote in the only note ever sent in their deliberations, "of the inconsistencies we are supposed to deliberate on."
In two instances, results were crazily contradictory, and the judge had to have the jury go back and fix the goofs. As a result the damages award was reduced to $1,049,343,540, down from $1,051,855,000. For just one example, the jury had said one device didn't infringe, but then they awarded Apple $2 million for inducement. In another they awarded a couple of hundred thousand for a device they'd ruled didn't infringe at all. This all was revealed by The Verge in its live blog coverage:

The jury appears to have awarded damages for the Galaxy Tab 10.1 LTE infringing — $219,694 worth — but didn't find that it had actually infringed anything....A similar inconsistency exists for the Intercept, for which they'd awarded Apple over $2 million
Intercept: "The jury found no direct infringement but did find inducement" for the '915 and '163 utility patents. If a device didn't infringe, it would be rather hard for a company to induce said non-existant infringement.

Obviously, something is very wrong with this picture. The Verge also reported that the jury foreman, who is a patent holder himself, told court officials that the jury didn't need the answer to its question to reach a verdict:
The foreman told a court representative that the jurors had reached a decision without needing the instructions.
That's why I don't think this jury's ruling will stand, among other reasons.

I thought it wise to highlight this, because I saw this morning that some missed seeing it. For example, James Niccolai at PCWorld quotes a "legal expert" who clearly didn't:
"It's surprising they came back so quickly, given that it was a complicated case and very complicated verdict form, but that said, it looks like they were thoughtful about it and they did their job," said Roy Futterman, director at DOAR Litigation Consulting and a clinical psychologist who works on trial strategies and the mindset of jurors.
"One sign of that is that the verdicts were consistent, they held together -- they voted one way on infringement and another way on invalidity; it all tells the same big story," he said.

Since the jury found that Samsung WILLFULLY copied and infringed Apple's patents (which wasn't a difficult decision to reach, thanks to Samsung actually documenting its discussions of doing just that), Apple is entitled to request that the judge award TREBLE DAMAGES!!

It shouldn't.

The entirety of the Samsung case was about the design of phones themselves, and relying on Samsung's emails detailing how to make a phone close to the iphone.

This being said, I'm pretty sure we are talking about the first gens, which are not really even relevant anymore. Who in their right mind would think an S3 is an iphone?

After digesting the news of Apple's major win in this court case, and reading a 101+ articles of opinion on the matter, I have concluded that many people are worried to some degree. Some feel that Apple is going to go after every major hardware manufacturer with a vengeance and certainly renewed vigor. Some feel this will kill innovation.

What's your take on this?

I have read a few articles on this as well. I think that it will not effect anything major right away, since a lot of the devices that infringed were older devices. I think that this could help Apple slowly intrude on the market, and if they are not careful, they will get hit with a monopoly tag by the government, especially with what they are claiming as patents.

I think that a lot has yet to be decided, pending the Motorola case that Apple is also involved in.

Here's a thought . . . maybe this will force them to do some more thinking outside of the imitation mode everyone has been in since 2007 and someone will make something equally as innovative as the iPhone
