Microsoft offers Disney a form of region encoding on this stuff, but doesn't want HD DVD to have it. As somebody pointed out, once a studio puts stuff on the XBOX marketplace it cuts down on their incentive to also release on HD DVD, since they already have a way to get money from a large portion of HD DVD owners (given that a large portion of them have the XBOX360 add-on). That may change with time and I don't think people can actually buy the movies on the XBOX marketplace at this point, but it does seem like it gives the studios less reason to release the movies on those discs.
