It's also possible – and quite likely – that Criterion never sold out their initial run, and are still selling remaining inventory. They've every right to do this, whether they still hold distribution rights or not. Of course, if they do still hold the rights, or renew them, it's highly unlikely they'd settle for releasing the UK's barely-HD master.
