without a lower denominator to cater to, i dont see why we'd get half-assed efforts on new upcoming discs. titles alread released on hd dvd to be newly released on bd (like bourne) it's possible tho.

My belief is that not too far in the future, all the studios will see the benefit of encoding video at higher peak (and average) bitrates for Blu-Ray. And this is not because of the small but visible (to me) quality advantage, but because 50GB of AV today, is still a deterrent to people who want to store them on HDDs, and presumably keeps a segment of the population from eyepatches --- something no longer possible now SD DVDs, since there's perfect digital bootlegs
In the short term, they'll use what they already have to cut costs. Paradoxically, when it comes to operator time and compression costs, allowing higher peaks is cheaper for them since they spend a lot less time reencoding and playing with the region of interest (ROI) to make the compression fit under a lower limit that comes with HD DVD. 40MBps is also a very effective deterrent to fight against downloads and IPTV since shining light on the 4MBps AppleTV and other attempts in that area is very ...... enlightening. I don't know if it was his decision or just an order from GE/Universal's Chairman, but Kornblau said last year he wanted the format war to continue, talking some nonsense like it being good for consumers. Now here he is saying it's cause to celebrate it's over. While I agree it's cause to celebrate, he hasn't, publicly atleast, been a champion of a unified HD format.
