Looking at NYC in that image, I was very surprised to hear that buildings have copyrights/patents and require the rights to replicate in a movie. The Chrysler building for example, was not allowed in Sony Insomniac's Spider-Man 2 video game because they didn't get the license rights to portray it in their video game.

But did Marvel get the rights for this film? Isn't that it in the city background?

Yes, and quite prominently in the first Avengers film.
