Mike from GHV provided some needed insight regarding JB4D in Reddit:

“They aren't suing. They sued. I had to pay out over $8000. Not sure what the other settlements and payouts were.

For selling the reissue. It shouldn't have involved the retailers. We can't check rights on every movie that comes in so we have faith that the companies have legitimate rights to the films they release. They also waited years after the release to sue everyone. We should have gotten a cease and desist and they should have sued only Code Red and maybe Kino for distributing it. Instead they went after all the retailers they could find that still had it in stock or on their site. I paid 8 grand for the 10 or so units I sold.
I've talked to Dave from Dark Force and he seems to be confident they don't even have the chain of custody for the legitimate rights. We'll see what happens.”

I’ve read the rant above several times as well as Mikes comments and I think they in this context is synapse, saying they sued the retailers for selling the code red reissue since CR didn’t have proper rights, and Dark Force is saying Synapse does not actually have rights to JBD. I think that’s the story?

If that’s true, that’s…pretty messed up? Why should retailers be on the hook/subject to lawsuits because the label(s) messed up the rights? How are retailers supposed to know that?

Well, hypothetically, if a retailer sold bootlegs of Warner Bros entire catalog from a different label, do you think they would not be on the hook legally?

Obvs this is a far less extreme situation than that, but its the same reason they can sue in this case

I don’t disagree, but I do feel like going straight to a lawsuit for the retailers instead of doing a C&D first seems a bit much, especially when the retailers are actively carrying your products and doing business with you. Shrugs.

I speak for everyone when I say, we don't care. Keep this drama behind the scenes. He wanted to hush up the other dude complaining about Dark Force publicly.

I'll still buy the releases that interest me from Dark Force, but this is un-needed.

I know a lot of people seem to love it/find it entertaining, but “boutique releasing as wrestling” is really tiresome to me. Just release shit or don’t - why the hell do I even know who these people are/their personal/professional grudges?

If someone can release Just Before Dawn 4K - great, release it. Otherwise say there’s “rights issues” and leave me out of it.

The court documents referenced from the links on Reddit are very interesting. So, Redoak Communications, Inc is suing many parties for copyright infringement. The president of Redoak Communications is Vlado P Hreljanovic who is an executive producer of Just Before Dawn.

Guess we'll find out more in a few days since Redoak Communications has until 11/12 to amend their filiing.

What seems odd to me is they said they paid $8,000 and only sold about 10 copies. Why pay that much unless court costs were going to be more or they were relatively sure they would lose the lawsuit?

Listen Cloudnine this is a very crafty very complex lawsuit that has been now going on for years as well as a fantastic money grab for Vlado and Synapse. But the party is over now that Dark Force has joined in. What information do you have to say that Synapse is even invovled as they're not even listed in the lawsuit?
