I say tie. They both played the character to perfection under two very different circumstances. Jack Nicholson's Joker does not work on Chris Nolan's vision of Batman and Ledger's does not work in Tim Burton's vision as well.

Because I think Burton's take is painful to watch, and Nicholson's fat overweight middle-age clown is just more of Nicholson's shtick other than a character, using your rules I give 100% to Ledger.

You're missing a couple of options.

By the way it's Nicholson, Romero, and Ledger. If you want live action.

Though Mark Hamill's version from the toon also gets high marks.

It's on youtube. You can find it easily. I actually have this on DVD somewhere. It's my favorite Batman. The Joker is great in it. They need to make a full two hour movie of it.

I think it's a YouTube video. Just search "Batman vs. Predator" and it should come up. It's okay, I guess.

I like Jack's more, but Heath is definitely more terrifying as Joker. Keaton's Batman would be screwed if Heath was running around his Gotham!

Haha, yeah. It's actually done very well considering the look.. decent acting, costumes and such. I think that Batman looked really cool too, going back to the grey that Adam West used to wear. Awesome costumes Although I'm pretty sure Predator would destroy Batman instantly.

Anyways back on topic, Nicholson is awesome as The Joker but Heath's performance was absolutely brilliant. The way he made The Joker is haunting.
I also have to give props to Mark Hamill as The Joker from the animated series because I always have loved his voice performance, his laugh is perfect . I'm so psyched that he is returning for the upcoming videogame.

My pick goes to Heath but both Hamill and Nicholson are fantastic as well.

When I watch Jack as the Joker it kinda takes me out of the movie. It's just like watching, Jack being Jack w/ a Joker twist if that makes sense. When I watch Heath, I completely forget it's Heath and become drawn into the character of the Joker.
