Apologies if this was already posted somewhere, I couldn't see a thread. I find this very interesting news, I wasn't aware he had filed a lawsuit against Europacorp and Luc Besson.

Very interesting indeed. I have never watched Escape from New York but Lockout did have numerous cliches. This could set a precedent but payout is probably too small to bother.

He's made some brilliant films but sometimes I think Carpenter comes across as a bit of a douche.

He's only mad cause he didn't get paid. Other wise it would have been fine. That's why he sued to get his money.

Why should he get paid? Filmmakers steal other people's ideas all the time. I guess Quentin Tarantino owes money to about a billion different directors.

Carpenter didn't bother me too much, surprisingly, but John Landis was unbearable to watch. But then I've never liked him. Of course, Cronenberg was cool as ****.

The 'form of a film' is a copyrightable element?

I don't know. he probably feels he's owed that cause he was ripped off. He has no problem with people remaking his films as long as he gets the checks in the mail.

If you actually read the article it stated part of the reason of the ruling is due to Carpenter having previously talked up the idea of "Escape from Earth"

Hadn't even heard of this lawsuit before. Lockout was an okay time waster for a rainy afternoon, but the whole I was watching it I kept thinking "It's basically Escape from New York in space." I even seem to remember the opening scene essentially being a lift of EFNY's deleted scene of Snake Plissken's theft and capture.

I'm amazed he won this. Basic story motifs are not copyrightable, otherwise everyone would be suing everyone else all the time and Shakespeare should be suing everyone because it all either came from him or from Greek and Roman myths anyway. I don't think he would have won had this been a U.S. lawsuit.

He only got $20K. That probably didn't even pay for his lawyer.

How many westerns have basically the same plot elements? The original Star Trek TV show was sold as "Wagon Train in space". Almost every love story is "boy meets girl", "boy loses girl", "boy gets girl".

"The Martian" was a combination of "Cast Away" and "Apollo 13". Although the plots were different, a large part of Star Wars was certainly indebted to Flash Gordon and Edgar Rice Burrough's Martian series (John Carter). Etc. etc.

If he's entitled to money I don't see why he shouldn't try to get it. I would be pretty upset if my friend, and I came up with a successful film, and elements were ripped off. I would be even more upset if unique plot points were also stolen, and it was so blatant that it could be proven in a court of law.
