Default Holy jebus! Someone broke into my apt!

I was working on my paper (that I posted about earlier this month) at around 230 AM when I heard a window break in my kitchen. 230Am. Monday Morning. Monday after Mothers Day!

Anyway, grab my Beretta (Closest weapon that was condition 2 -or would it be 1? SA/DA- ), give a firm warning, see that the window is in fact broken in time to see a leg in my apt up to the knee, then retreat to the bedroom to check on my sleeping GF.

Go out Clear the area as best as I can reasonably do (the immediate rooms and the areas just around the ground level points of entry). No john Rambo shit, just cut and dried "make sure he can not ambush me through a window." Know I am scared because he knows I have a gun, I know that if he wants some he will be prepared for me being armed, and will act accordingly (element surprise is totally gone).

Retreat back to the bedroom, get my shotgun to condition 1, pass my pistol to my capable GF, hang tough for a couple minutes until the cops came.



3 cars show up, comb the area, come up empty, stick around for a coke and some bullsh*tting for a half an hour.


Slept from 6am to 7am straight.


I think this one might have taken the cake for most scariest sh*t to happen to me. NOTHING like having an actual intruder while you are alone at night.

I was laughing just because I think he didn't think he'd be in for a battle with a 92F (my guess on the Beretta) and a shoti lol

im looking to get a mossberg 500 getting a little home defense

Did you call the Reno Sheriff's Department? I'm sure Dangle would have caught the guy.

In all seriousness though that would be scary. When I was younger and lived with my parents I always got really anal when they would go on vacations and leave me alone because they lived out in the country in a pretty expensive house. I'd usually check and make sure the doors were locked multiple times. I'm not as anal now at my own house because I live on a busy street and the cops would be at my house in about 4 minutes if there was trouble. I've considered getting a gun but I have no history with guns and I'd be scared I'd accidentally shoot myself.

Can't a perpetrator sue you for assault and battery if you shoot them while they're breaking in?

glad u're alright...if i had a gun in my house and saw a leg in the window already, i wouldn't hesitate to shoot a round into the ceiling or wall just to make sure they knew i was there and watching them!!!

not if they're dead. Anybody who's every been trained in guns knows that if you pull a gun you don't aim for anything but a lethal area. especially if you're using a shotty with Magnum high yield shot at less than 15 feet

lol I have no idea why that made me laugh so hard.

I guess I could just imagine a guy breaking in comes in your room hears that chilling sound of the pump action and he just goes oops and you go "yeah OOPS"

I doubt it if he broke in and you felt threatened and you sent him packing. I think all they'd have to go on was the physical evidence and since no-one could corroborate the story but you and the physical evidence of an intrusion then they'd have no case.

Anyone can sue for anything at any time. The issue is the strength of their case. This is all an educated person would say at the scene:

"I was in fear for my life"

"I am sorry but I am very shaken up from this experience. My lawyer and I will be happy to answer any questions you may have tomorrow.

Repeat either line as often as necessary, making sure that these are the only two things that come out of your mouth. The investigating party might not appreciate it but your lawyer certainly will.

On topic: Glad that nobody was hurt and you had the tools and training to keep it that way.

It's a great thing that no one was hurt (including the intruder -- for what it's worth). I had a little trouble piecing together your story, but it sounds like the guy split after you warned him by giving him a "firm warning". What was the warning that sent him running? I'm curious about that.

To answer the legality questions that are starting to pour in...If someone dies, obviously they personally won't be able to sue for it, since they'd be dead. Someone else will take the shooter to trial, though, or at the very least there will be a thorough investigation of the events. From what I've heard, different states have different laws when it comes to protecting one's self during a home invasion.

Glad you're o.k.....

As far as getting sued.... it's usually when you shoot them while they're leaving, when that becomes more likely.... and besides that... far more burglars are shot, and end up dead or in jail.....than ones that become "news" stories for a lawsuit after-the-fact.


I unfortunately have no shot-gun (haven't been hunting in awhile) and my only current method of home-defense is a Colt Defender (.45)

It's nice... but there isn't much out there that is more fool-proof than a shot-gun!


I pulled it out one time at night from a loud noise in the garage (it was a bike that was hanging, and the hooks finally gave out, and the entire bike fell, and knocked over a table etc) and that was pretty scary.... having someone in your home has to be freaky....

I was robbed at gunpoint 3 times though.... but I wasn't in a position to defend myself in any of those instances.

again... glad you, and the GF are alright. I guess it pays to study

This happened here in Virginia a couple weeks ago...

Home Intruder Fatally Shot & killed by elderly man During 911 Call

The entire event was caught on the 9-1-1 call, apparently the man was extremely drunk and acting a fool.

The kicker...[drunk guy's] friend kicked him out of the car near this poor family's house for being too drunk in the car.
