His listing fails to mention anything that you described so I would not consider it to be in "good" condition like his listing says.

File a claim with Ebay / Paypal that item is not as described.

He may try to discourage you by saying he will only give a refund if you return the item to him first, if you do make sure you get a tracking number.

And of course leave neg feedback with precise info in a professional manner. If he responds in a ragey manner (like he did with the last two neg feedbacks he received) it does not look good on him as a seller.

Could be but when listing a DVD or blu-ray on E-Bay there is a specific field that says "Ex-Rental?" If it was an ex-rental, and it's sounding like it was, he should be selecting "Yes" from the dropdown. By not doing so, he was being deliberately deceptive.

There's truth in this. The entire reason for the plastic scratch-resistant coating on blu-rays is due to the fact that scratches affect their playback more than DVDs because the readable info is closer to the surface.

I've had DVDs that were scratched really bad with many all around the disc still play fine & I had a BD with just 1 long but very faint scratch & it skipped.

Yeah, I opened up a dispute to get a refund.

You can tell where someone was scratching at the label to get a sticker removed. If you look at the back of the disc at the ring area you can sort of see through the disc were scratch marks are made.

That sucks dude. You should ask him why he would sell you a disc with sticky residue on it (assuming it wasn't mentioned in ebay listing, I just looked at the pictures before).

I tried that with first couple ex-rents I bought from Family Video, but had no luck and didn't want to cover the disc in goo-gone, so I just leave em now. Haven't had one affect playback so far (knocks on wood). Those things are just too sticky and come off in tiny pieces and layers, if at all. If you got some sweet trick for those nasty things, please share.

Wow...yeah that is just ridiculous. Hopefully with you opening a case against him, you get a full refund.

EBay is great 95% of the time from my experiences...and then you have this guy. Hope they t all works out for you.

Caveat Emptor, indeed. This seller didn't even bother to conceal the alleged "BD's" catalog number (DV12167-1) clearly sourcing it to the U.E. set, which, as we all know, is a DVD-only release. What a lazy turd!

I agree with TripleHBK's suspicion that this is probably also a bootleg. Which format is anyone's guess. Whoever bought it got ganked, big time.

Default Dawn of the Dead (1978) - OUT OF PRINT

I think it’s a legit disc, someone out there just swapped the disc in their UE. This is the leftovers combined. Makes sense to throw the undesired DVD disc in the undesired packaging. It’s not cool to try to sell it off that way though.

I know a lot of people did this with stuff when WHV had that disc upgrade program, people upgrading their Superman DVD tins etc.
