I agree with bwdowiak. I'm sure it isn't a reflection of Indians fans, but of just a sore loser who felt the need to take it out on a outnumbered Cub fan.

I don't believe everything I read or see on the internet, especially from a "reliable" source such as TMZ. They sure do love to stir the pot and cause controversy, don't they? Regardless of what went down, the supposed drunk Cub fan should not have been punched. You fight to defend yourself or someone else, that's it. You don't hit a defenseless person because they hurt your feelings. This was not a fight, and it doesn't matter if this was in Cleveland, Chicago, New York, Boise, doesn't matter. It's inexcusable. Why'd the two run away afterwards? They clearly knew what they did was criminal. Both these pricks are pusses.

If true, that jerk was asking for it, but to punch someone with their hands down is cowardly. It's best to walk away from idiots like that. Why risk your life? You never know these days if someone is packing or has a knife. In my twenties I was quick to fight back and it didn't work out to well for me one time. Some guy confronted me, so we got into it, and before I knew it, I was getting my ass kicked by 8-9 of his friends. Nothing I could do as I was being punched and kicked on the ground. It's not worth it.

I had to step away from this crazy rally on tv... My God there are millions down there!!!! I did that when I was younger in 1991 for the Bulls rally and will never do it again...

Brad, as you probably know, it's no different than the thousands that are around Wrigley on a daily basis. They limit the drinking at the park, but it still doesn't help. Young, dumb and drunk is a bad combo, especially when you are at a visitors ballpark...

Lastly, the guy that punched him needs to be in jail, regardless of what the stupid Cubs fan said. It's flat-out assault and battery regardless of the words coming out of the Cubs fan's mouth...

As an attorney who has practiced criminal defense, this is a case that I would gladly take to a jury trial. No way a Cleveland jury convicts the Cleveland fan after the Cubs fan, a drunkard who has a history of harassing and stalking women, taunted the Cleveland fan about the Indians loss (immediately after said loss) and literally dared the Cleveland fan to punch the Cubs fan. Automatic jury nullification.

Only a litigator would respond like that. I think you are missing the point. I am impressed though that you knew the Cubs fan had previous 'problems', great detective work there. You are all set to try this case...

A taunt lead to an argument. That argument lead to the Indians fan saying "fight me." A few words (the "dare") doesn't justify getting knocked out cold and according to that account, it was the Indians fan who said something about fighting first.

If the Cub fan is a jerk than maybe he got what he was looking for, but the Indians fan did something criminal there. Theres no doubt about it.

Juries don't always make decisions based upon the facts and evidence, they are easily swayed by emotion - even more so when the complaining witness in a criminal case is unsympathetic. The decision in the Bundy case is the latest and most glaring example of that. Whether or not the actions of the Cubs fan fit the legal definition of provocation is irrelevant in this instance.

A bench trial in this case would most likely result in a conviction. But, a jury trial in Cleveland, no way.

Of course, the Cleveland fan's attorney could always plead him out to a lesser charge before trial. But, this is a case begging to go to trial with a Cleveland jury. If you aren't familiar with the Cleveland jury pool - and, if you have never been in a Cleveland courtroom, you wouldn't be - then it isn't so easy to see why this would be a "slam dunk" case for the defense in a jury trial.
