I believe that in the case of Badlands the rights actually were with producer Edward Pressman, which was the reason Criterion were able to acquire the film.

Nightbreed is not owned by WB, Morgan Creek owns it. Originally theatrically it was released by 20th Century Fox, WB only released it on DVD.

The House on Haunted Hill is a public domain title. WB probably had the best elements and so they let Shout use them.

I know it's public domain. My point is that nobody licenses elements for free, especially if there's are superior to other PD elements holders.

I misuderstood what you were say. I'm just saying since it is public domain they did not really license the title more than they provided the best elements.

For MST3K , Warner probably could care less about using those titles and / or not planning on doing anything with them. I cannot see them doing a blu ray for any of them ..although the Black Scorpion would be welcome

Of course not. But some of them are available via Warner Archive on DVD. Either way, Warner from 1996-2012 wouldn't license ANYTHING under ANY circumstances, so their recent exceptions are notable.
