I’ve read the Consumer Rights Act 2015 http://www.legislation.gov.uk/ukpga/...ntents/enacted and under “What statutory rights are there under a goods contract? Section “11.Goods to be as described”, you (HMV) have entered a contract to supply said items as is, I have copied this section below.

Goods to be as described
(1)Every contract to supply goods by description is to be treated as including a term that the goods will match the description.
(2)If the supply is by sample as well as by description, it is not sufficient that the bulk of the goods matches the sample if the goods do not also match the description.
(3)A supply of goods is not prevented from being a supply by description just because—
(a)the goods are exposed for supply, and
(b)they are selected by the consumer.
(4)Any information that is provided by the trader about the goods and is information mentioned in paragraph (a) of Schedule 1 or 2 to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (SI 2013/3134) (main characteristics of goods) is to be treated as included as a term of the contract.
(5)A change to any of that information, made before entering into the contract or later, is not effective unless expressly agreed between the consumer and the trader.
(6)See section 2(5) and (6) for the application of subsections (4) and (5) where goods are sold at public auction.
(7)See section 19 for a consumer’s rights if the trader is in breach of a term that this section requires to be treated as included in a contract.

Reading the above, particularly section (5)A, in my option, HMV have broken the terms of the Consumer Rights Act 2015.

Seeing as I purchased 3 of these steelbooks in good faith that this would be the most complete collection available at the time of pre-order, I am disappointed in the fact I was not made aware of any changes to the said steelbook(s). If I was made aware before payment was taken then at least I would have had the choice to cancel my pre-orders or continue with payment, and to acknowledge the change in the item(s).

Seeing as I have not had anything confirming the change in the number of discs in the set, and seeing as I purchased a 4 disc set. I would like said 4th disc to be provided to myself and to be fair, anyone else who has purchased this item in good faith.

It maybe that Tesco UK have rights to said bonus disc, but that is then on you (HMV) to resolve this issue, and of course no additional cost to the customer.

I’m a bit torn on this whole HMV missing disk issue.

On the one hand it should’ve included as it was advertised as such. I can see why some people are upset by it.

On the other hand it’s only a 20 min feature that might not be a big deal. Even when a blu Ray includes a bonus disk as standard I rarely play it.

Either way it’s nowhere near the UK Avengers Blu Ray debacle of 2012.

I'm not disputing that HMV haven't ballsed up - they said the set included a bonus disc when its clear now that it was only going to be a 3 disc set.

They've sent out an apology to those who have sent in an email and corrected the listing. Not sure what else they can do in this situation, especially if Tesco does indeed have the rights to the bonus disc.

But then I've seen that HMV are selling a two-disc DVD set which includes a bonus disc so it's a 20 minute DVD by all accounts that as you say, might not even get looked at.

Is it really worth getting that worked up over? Not sure it is.

It was listed at the time of pre-order. There for as i have listed above. The law states they have broken their sales contract with the consumer.

I've paid £24.99 for a 4K, 3D and 2D release - which is what I've received today. There is no indication of a bonus disc being included on the packaging. Can you confirm that you have received items that mention any form of a bonus disc inside the steelbook?

It was an error on HMV's side. I've never stated otherwise. They've apologised and amended the listing.

I really hope you do get your DVD's so you may find peace with this situation.

not good enough. i bought in good faith a 4 disc product. i received a 3 disc product.

if you are OK with it then fair play, it's your money. i am not OK with it.

their advertising stated at the time of pre-order, a 4 disc set, 2d,3d,4k and bonus disc. now if they lost the rights to said bonus disc, they should have informed the customers who pre-ordered it and said they are changing the order, that is what i have stated in my email to them. it's clear they got it wrong and are now changing their site to remove any mention of said bonus disc.

this is against the regulations in the law, as i have said in my email to them.

i am more annoyed with the fact they didn't tell us. rather than the disc being missing.

but if you are not annoyed then again fair play.

Picked up the Steelbook in HMV at Lunchtime, and asked the staff if they had anyone flag about the 'missing' bonus disc.

One of the guys thought it might have been a website exclusive

Shame about the error, but as has been stated, it's a 20 minute DVD that'll be watched once.
