Default I keep hearing about a Warner lawsuit...

I've read several times from HD DVD fans that HD DVD has grounds for a lawsuit against Warner for breach of contract. I know these are just internet nobodys just like me, but I do have to ask... Do they have grounds for a lawsuit? I thought Warner was waiting until May so they can avoid something like this. Is making an announcement a breach of contract?

I know that these are HD DVD fans and will say anything, but I was just curious.

One of the insiders said not to worry about it saying this sort of "thing" had been anticipated. He might have used the word "complications", I can't recall for sure. Just check the insiders thread.

P-man said it was taken into consideration (the contracts, etc) on the insider's thread. Can't find the quote though. Sorry.

I'll bet it's just because Warner announced their intentions to go with Blu-ray before their contract with HD DVD had technically run it's course, which would be end of May. Unless Warner's contract specifically says they cannot announce their company's intentions to shift away from HD DVD before the contract is up, then there shouldn't be a problem.

We don't know for sure, but I can be fairly confident when I say there will be no room for a lawsuit, companies that big know the contract they are in, they hire very expensive lawyers to look over it for them so that they can't get in trouble.

I wouldnt but any stock in what they are saying until a credible source confirms it. However, you have to keep in mind that Warner has its own legal team and they prolly analyzed the decision very closely (hence the "were gonna keep releasing HD DVDs till may" part).

I am both amused and annoyed that the HD DVD fanboys believe Warner should have less freedom to chose who it wants to support than Paramount. Honestly, how quickly did they forget about the $150 million payout and start to fabricate a $500 million payout to Warner. Then they have the audacity to say Paramounts choice was "pro consumer" and Warners was "anti consumer," when in fact Warner is the one who based their decision on what consumers have been buying.

To a HD DUD supporter the consumer is the group that didn't buy into HD Media yet and is still using DVD.

It took me a while but someone explained it to me. I was actually more difficult to accept then that silly attach rate non-sense.

The consumers didn't buy in yet but HD DUD was thier choice.

Seems pretty clear no?

One of the many articles I have read recently said that fulfilling their contractual obligations is why Warner is waiting until May. After that, Toshiba has no grounds for anything.

I do actually get what they were saying now, but I still disagree with them. Everyone I know who did not buy into HD media, wants a Blu-ray player. I have yet to meet a person who wants HD DVD but doesnt already have it. HD DVD is at a price point where, if you want it, you can buy it. Blu-ray has the consumers sitting on the sidelines because they cant afford to jump in.

Don't you think that Warner would have a better idea then HD DVD fanboys about all the possible ramification. Let's face it, every studio/company has a slew of lawyers that go over every detail of everything before any decision is made. Obviously Warner knows what they are doing. If they are not woried I don't see why we should be.

the consumers are people that are as dumb as they are, unfortunately for them there are not that many consumers, fortunately for us there are a lot of buyers of HD media and players.

Old business saying, "Those who fail to innovate, litigate."

Suing your way to prosperity was something RCA did a long time ago because people were using tv/monitor technology they invented. They sued anyone from computer companies to video game companies and WON! It accounted for a large portion of their income for a while.

I wouldn't worry about it. Suing Warner is an act of desperation and an act of sabotage because some people want both formats to fail.

Now I wonder who that could be?

Seriously, this is just another form of the new (and unimproved) FUD being spread by the red camp. Can anyone point to a legitimate (read: non-blog) website or news source regarding this? It's just more desperation from a losing team that refuse to bow out gracefully.

And since someone mentioned a $500M payoff: that was a discussion started here, on Blu-ray.com, as to how much it might take for Warner to have gone HD DVD exclusive. Geez, they can't even come up with their own original FUD...

True or false, what do they expect litigation will get them? They won't force Warner to start releasing HD DVD's again, so the whole thing is pointless.

But if they want to waste their time and money on yet ANOTHER hopeless cause, I say KNOCK YOURSELF OUT.

Warner has a contract to support HD DVD until, I'm going to go out on a limb here...May.

If their contract is like Universal's, it only stipulates "quality titles in decent quantity", a very subjective term to be sure.

I seriously doubt Toshiba is in a position to sue them, and that they will have, as penton said, anticipated everything

The HD DUD boys are grasping at everything out there. I have never seen such a delusional group of people - Lee Stewart currently the leader at AVS.
