That's what I don't get, the phone itself is fairly meaningless. The records on the phone could be messed with by erasing certain messages, but the phone provider could provide a full transcript of every text message sent from the phone.

I really think Brady should just take the suspension. It's an uphill battle to win a federal case and with him destroying his phone and not cooperating it's going to be tough to win. The problem is he could get the injunction to play initially, but then in November or December lose the court battle and become suspended for the end of the season or playoffs. With games vs. the Steelers, at the Bills, vs. the Jaguars, and at the Cowboys there's a good chance the team is 2-2 at worst, which is the same record they started last year with.
One thing I'll never understand is why Brady didn't cooperate with Wells' investigation. Wells told Brady he and his lawyers could print out all his texts and black out anything not related to their investigation. They didn't want him to actually turn over his phone. Why wouldn't you cooperate with that? I've heard speculation that the NFLPA didn't want him to turn over his phone because that would have set a bad precedent for players, but if he had given the messages there's no way the suspension would have been as severe, and it's possible the suspension would have been overturned since the NFL in their ruling today admitted the Wells Report has problems. |

I still don't buy referring to a guy losing weight as "the Deflator", and that overrides anything else I've seen in either the Wells report or the rebuttal. *EDIT* One thing that's clear though, if the Phone company has the texts or not was irrelevant to the Wells report because there is no way that Wells was in a position to demand them. The thing is Wells wouldn't know if Brady had texts that were admissions of guilt because Brady and his lawyers could have just blacked out the texts. He definitely didn't text either of McNally or Jastremski because Wells had their phone records since their phones were team-issued, so even if he was admitting something to someone else Wells would never know it was missing.

I still don't understand why Brady just didn't swallow his pride back in January. All he had to do was have a press conference and say that he didn't know letting a few pounds of pressure out was breaking the rules. He could have apologized profusely and still vowed that the integrity of the game was important to him. He would have gotten a big fine, but he wouldn't have this mess. He's in a world of hurt.

Considering that a simple factory restore can essentially do the exact same thing, this really doesn't mean a whole lot. The reality is that the phone company has all these records but the NFL's crack team are too stupid to realize that.
