Many have released that version (obviously including the body of the film) unchallenged, (including Legend 3D who converted it), but I can understand being cautious, especially in your position.
In 1950 a 73-minute edited version was distributed by Lippert Pictures, retitled March of the Wooden Soldiers; it was released without a copyright notice. The edited version of the film had the opening tune "Toyland" trimmed and the "Go to Sleep (Slumber Deep)" number cut completely. Also removed were Barnaby's attempted abduction of Little Bo-Peep and his ultimate fistfight with Tom-Tom. March of the Wooden Soldiers has been distributed by many motion picture and home video companies over the decades, as if it were in the public domain; however, because it relies entirely on copyrighted material from the 1934 film, March of the Wooden Soldiers itself falls under the same copyright as its parent film and will not truly enter the public domain until that film's copyright expires in 2030. Nexstar has not enforced its copyright on March of the Wooden Soldiers, effectively making the film an orphan work.

Not exactly the best example to use. The owners of Babes in Toyland simply haven't felt the need to enforce their copyright, even though it does exist. Lawyers probably cost more than what they'd make with the property.

If you want to poke the bear with Hannah Lee, more power to you. Maybe it will spur Wade Williams' estate (which I assume has control of the copyright along with materials?) to do something with it.

For the record, the quote you just gave is from Wikipedia, and it is the only part of that section that says "citation needed", i.e. someone edited the page with their unqualified legal opinion stated as fact, so definitely not the best source to clear that up. As for Wade Williams if anyone owns the copyright it isn't him (or rather his estate), you can research that and his other faulty claims elsewhere.

There are copyright lawyers who you can pay to research and dig up primary sources to help clear up these sorts of confusing situations. Pretty sure 3DFA has employed them before, so I'd consider what Bob has to say carefully.

We have one of the top copyright lawyers in the business and I’m not going to get into any details publicly, but we have looked into this matter extensively…

I suspect an initial PM could have averted the public wanting to know more about this....

Fingers crossed that a legit 3-D release in conjunction with the 3DFA can somehow happen someday…

As old and choppy as this looks, I still found it very watchable. There's some outstanding use of 3D and the film itself is a better Western than the ones we got on 3D Blu-ray. I would rebuy this without question if it got a restored release. It's made me want to see more 3D Westerns.

Hi 13th,

Based on your assessment from a few weeks back ordered it tonight from variety films.

I was really pleased with it. The source is in terrible condition so expect the worst there (literally) but the 3D is still great.

Got my copy yesterday,

To be quite honest, considering the poor and faded condition of the original elements, I was surprised how strong the 3D was. Variety Films did a fantastic job. Lots of depth and spatial separation. I was also fortunate to have an option on my Darbee 5000s for low resolution video which did improve the sharpness and color. The stereo cards and other extra features were fun to watch. Only disappointment is that the 1971 "I Monster" is not available on bluray. The 3D snippet (which included information on the pulfrich effect) looked great.

A B-western, despite low quality video (and again, Variety Films did a great job making it watchable) the 3D definitely makes this a winner.
