I mean, is it even legal for them to sell something that does not even exist? Sure, they don't charge you until it ships but still.

Since they don't charge until shipping, it's legal.

Don't think it's any guarantee of anything...I remember To Kill A Mockingbird and The Birds were listed on Amazon - both had prices, I had them both on pre-order for something like 2 years. I eventually cancelled them, and when TKAM actually came around it got replaced with two different entries (regular blu and digibook) anyway.

I think that's possibly a sign that it's coming out soon, at least moreso than them just having a page up like they do for stuff like Princess Mononoke

Although they've had The Birds up forever with a price to pre-order and that still doesn't have a firm release date

edit: just noticed someone else mentioned The Birds

Sometimes Amazon will do this to gauge the market and directly request the studio to release the BD.

Why would it be illegal?

They do this all the time. Basically as soon as something is "announced" they will put it up for pre-order. With PS3 games basically as soon as the major trade shows are done (E3, Gamescon) they will put up pre-order listings for all the newest games. Sometimes the announcement source is semi-official (not OFFICIAL-official) and they will run with it (see the Harvey blu-ray which had a release date and everything, then it got pushed back). But they don't just pull products out of their butt that don't exist.

On a similar note, some studios (especially small ones) will announce a BD to gauge interest, then use the response to decide whether or not to release the BD. Meanwhile, though, Amazon lists the title.

Well, whatever the case is, I hope Punch Drunk Love does indeed eventually come out on Blu-ray disc as it is without question my very favorite Paul Thomas Anderson and Adam Sandler movie. I even sold my DVD to Amazon in hopes a BD would eventually come out.
