We aren't just talking about theme songs made for a show... we're talking about existing music used in a show for mood. The CW used to use a lot of popular music in their shows and even would advertise the CD at the end of that night's episode. The CW obviously also was locking in home video rights to keep their shows intact with the music they used during the shows.

When you say "in the end everyone loses money"... The musician isn't losing money unless they allowed the studio to release without paying them. That's the point... the musician who owns the song he/she wrote trying to get paid for the additional use.

That's why I put all the blame up front on the studio producing the show. There's simply no reason in today's market to produce and air a TV show that you haven't secured rights for other distribution like home video for any included music. IF you don't secure those rights, don't use the song in the show in the first place... then you don't have any musician to re-negotiate with later.

Easy peasy.

I would hope so. They wouldn't have to... UniversalHD has been airing Quantum leap that clearly hasn't been restored... though it could be apparently...

I don't know what kind of money/time would be involved to "restore" Drew Carey. It might be mostly good already depending on how they did the later seasons that aired in HD... maybe only some of the early seasons would need restoration.
