Ebay Problems - How to get money back

Well I bought Superbad and Live Free or Die Hard from this seller on Ebay about 3 and a half weeks ago and have yet to receive them. I had 3 seperate orders with the same seller prior to this and I had no problems. I've sent numerous email with either a one sentence "your oder has been shipped" reponse or nothing at all. He says he sent them but when I look on Paypal all it says is that on February 18th the post office was contacted but does not mean that we have received. I guess its the same standard message when people print their own shipping labels is what I'm guessing. Anyways, I opened a dispute on Paypal on Sunday and again I get no response from this guy, all I want to know is what is the best way to get my money back from this seller.

That would mean he never sent them. If he did send them, the paypal would show "item received at so so location"

Just keep the dispute open, you will win, he has no proof.

You have taken the correct approach. The same thing happened to me. I paid for an item on December 28, 2007. USPS tracking indicated that the seller intended to ship my item. I posted negative feedback because the seller would not respond to my inquiry. The seller countered with negative feedback and even claimed that I had the item, that I was lying, and that I was trying to get the item for free. I opened a dispute with Paypal on January 16. I checked with the post office and they confirmed that the item was never received by them. In fact, the confirmation # is not even a tracking # as the seller claimed. It is simply a notification of the seller's intent to ship. Paypal states that it can take up to 30 days to make a decision. I received my refund on February 18.

In short, don't worry, you will get a refund.

As long as there is no record of the PO receiving the package, then you have a great chance on the dispute being resolved in your favor. Now, it's just a LONG waiting game for Paypal to do their "investigation". Good luck!

make sure you escalate the claim, just having a dispute open, PP wont interfere until u escalate it

Thanks for everyones help, I just got refunded today.

However, on a side note, I bough Die Hard With a Vengance on March 9 and I still have not been able to contact the seller on that transaction either. So I just opened up a dispute against him also. I've never been stiffed before on Ebay in 3 years and now I get 2 in back to back months. Both on blu ray transactions too. I bought 2 more yesterday so we'll see if I get those or I have to open up a dispute against them also.

are you checking their feedback before buying? I'd assume you are if you've been using Ebay that long..... but with stuff like Blu-rays (mass produced, "stock Photos" ) you gotta watch out!

I photograph everything, FRONT, BACK and inside(used) security seal if new.
Its a pain but helps sales

Delivery confirmation is the biggest waste of money service out there.

The only thing delivery confirmation tells you is that the package was delivered *somewhere* in the destination zip code. It's utterly worthless.
