Default Sony ToS reveals troubling update

Now, whilst I love Sony and all they promised. It does slightly worry me when they start updating their ToS to include this:

"You must not resell either Disc-based Software or Software Downloads, unless expressly authorised by us and, if the publisher is another company, additionally by the publisher."

Essentially that makes selling games a technically illegal act. Which given Sony's stance on the ability to sell and buy used games should NEVER have been included in an updated ToS at ALL!

Now, i'm hopeful they won't enforce it, but if they do it's a big slap in the face of gamers that supported them. And even including it shows disrespect for us imo.

All ToS's have this in them. This means nothing and we are still able to sell and trade our games to stores and friends.

I'm going to assume that when they announced the console, that was the point they gave is authorization to re-sell software. They made a huge deal about being able to sell/trade games. That was Sony giving us the go ahead, so we already have permission.

Seeing how just as recently as last week they have said you can sell your games, I'm not too worried about this. It's not like they said they will make a human centipede out of us like Apple does :-D

Thought this thread would be about this, a bit more troubling....

Sony can 'monitor and record' PSN activity


Sony's updated terms and conditions reveal that the company can actively monitor and record communication between players.

In a section in the company's new Software Usage Terms entitled 'Are we monitoring PSN?', the company declares that it is, but reassures that it is unable to monitor all communication.

Instead, Sony said it reserves the right to "monitor and record" text or voice communication, or user-generated media (UGM) where they feel it's necessary - for example, if another player submits a grief report. The disclosure comes amid widespread concerns over mass internet surveillance, after it was revealed that state officials across numerous western countries have been secretly accessing the user data of millions.

The full statement on Sony's site reads as follows:

Are we monitoring PSN?
Yes but we can't monitor all PSN activity and we make no commitment to do so. However, we reserve the right in our sole discretion to monitor and record any or all of your PSN activity and to remove any of your UGM at our sole discretion, without further notice to you.

Your use of PSN and our community features may be recorded and collected by us or sent to us by other users as described in 13.1.

Any information collected in this way, for example, your UGM, the content of your voice and text communications, video of your gameplay, the time and location of your activities, and your name, your PSN Online ID and IP address, may be used by us or our affiliated companies to enforce these Terms and the SEN Terms of Service, to comply with the law, to protect our rights and those of our licensors and users, and to protect the personal safety of our employees and users.

This information may be passed to the police or other appropriate authorities. By accepting these Software Usage Terms, you expressly consent to this.
Other agreements required in Sony's Software Usage Terms include the acceptance that all software is licensed, not sold, and that players "must not resell either disc-based software or software downloads, unless expressly authorised by [Sony]".

However, it is worth noting that similar statements have also been present in previous Terms & Conditions agreements for the PS3, PS Vita, PSP and Microsoft consoles.

The way I see it nothing is ever private on the internet; never has been, never will be. If scanning msgs on PSN can help stop any hackers or anything malicious I'm all for it.

Since PSN is the private sector and used voluntarily by the subscribers, I have no specific problem with it. But whether one is doing anything wrong or not has no bearing on privacy rights, and actually, it is precisely those who are doing nothing wrong that such violations should offend the most. You should be afraid, if the government should happen to want access to these records.

Doesn't bother me one bit. Like the article mentioned they only do it when needed. IE grief reports, threats etc. They don't sit around all day reading messages.

The problem with this is , a lot of fanboys jumped on this situations on both sides ( Xbox and Kinect and now the Sony POS ) . Companies do this to protect there derriere nothing else .

Also the same thing Skype has been doing for as many years as I can remember.

It's just there to stop griefers, racism and stuff like that! They can listen to me all they want but it'll be nothing interesting and a waste of there day!

Most things are monitored these days to look out for terrorism, criminality etc.

As long as it keeps me safe I'm happy!

Yeah, I see no big deal here. Of course if you use their voice chat or mail system there is a chance they will capture stuff. They need to be able to for inapppropriate or illegal behavior.

MS does it too - and really wouldn't have been a big deal there either until they had introduced the "always on" part with the Kinnect.

If you don't like it with Sony, you have the option of restricting what you say/mail or staying away from the mail/chat functions entirely and they won't capture anything on you.

The resale thing is odd, but I'm guessing that it's some odd legal thing that they feel they need to say it.

XboxLive is the same. They recently stated they can use voice and game DVR recordings as well.

If you are a member of the PSN/Xbox Live community you pretty much give up your privacy rights. If you don't like it, don't play online.
