Default HD-DVD class action lawsuit?

Should HD-DVD owners band together to initiate a class action lawsuit against Toshiba, Microsoft, and Ken Grafeo for lying to them over the last 6 months with the intention of duping them into buying into their format?

As any prosecutor will tell you: you can indict a ham sandwich but convicting it may present a bit of a problem. I can see it being filed but I doubt it's a winner.

nothing would come of it and I guarantee it will never happen!

Heres what I'm challenging anyone here to do:

Find an HD DVD owner who cares enough to file such a lawsuit.

I dont think that you will find one who cares enough. Now find someone to defend them.

Their opening statement would sound something like this:

"Ladies and Gentlemen of the jury, my client(s) have been lied to. They have been deceived by the media. They were told that they were buying the technological advances of the future and here they are; frusterated and livid at the fact that they wasted $99 on a player of the next generation $99!! Ask yourselves this concerned citizens, how can you let this go? There are litterally thousands of people that spent their hard earned money on this technology and now it is gone!... etc, etc...."

Im tired of typing it but you get the idea. It cant and wont happen

Do you not think that Warner knows what in the hell that they are doing, and have lawyers who checked every detail?
All the poor little reds getting all butt hurt and choking on their bitter tears...
Where was all of this talk when Paramount went blu hmm?

It'll never happen, and if it does, it'll be shallow and ill-conceived.

Although I wouldn't be surprised if Toshiba, Microsoft, Best Buy, Blockbuster, Paramount, the makers of Advil, gray aliens from Mars (not the greens, just the grays), Apple's iTunes, the state of California, my cousin Larry and Halliburton are all named as defendants. If you're gonna go tort, go big!

I voted no...why? Because we've been telling all the little Red ants that they should be investing in Blu-ray all this time. Tosh., M$ and anyone else involved in the lawsuit will say, "We gave the facts as we saw it (Exhibit A1-B19: charts and graphs presented here) and we felt we were not lying to anyone or misleading them. With this evidence and proof, we must point out that the consumer themselves made the choice--as we have hoped they would since the inception of the HD DVD format--we did not force the consumer to buy anything. In fact, we (insert another word for dumped so that they will keep out of trouble) over 90,000 units back around Thanksgiving 2007 in hopes that it would help the consumers."

In the end, the consumer will be seen more at fault than the corporations themselves and we will hear something in the news about almost 500,000 HD DVD Fanbois and a few unfortunate people who are crying their eyes out because they lost the lawsuit.

Sorry, but that is the harsh reality that I'm sure would happen.

i don't think a class action lawsuit will succeed... for one thing, both Blu and HD-DVD were advertising, and it is the consumer that made the choice between the two formats. You are accountable for the choices that you made.

Don't get me wrong, I am a firm believer in caveat emptor... but that DOES NOT relieve a company from being held accountable for LYING to consumers. And a fair case can be made that all three, Tosh, M$, and Grafeo have lied repeatedly!

I'm not sure. I think those of us by us I mean Blu-Ray and HD-DVD that purchased while the format war was going on all took a leap of faith.

One we knew could end for either party. Luckily for us we won. I know if the tables had gone red, I'd be upset, but I'd have no one to blame but myself. People need to start accepting their own mistakes and stop trying to blame others all the time.

if they're suing everyone who lied to them... shouldn't they also target rdjam and amir? All Toshi did was present their product. rdjam and amir misled the HD-DVD folks into buying into Toshiba's lame product.
