Mind your own darn kids - don't expect Microsoft too.

Make your son repay you the freaking $35.

I'd say if Microsoft gets held responsible for it, than Microsoft should be abel to sue his kid.

"Georgia resident Francisco Garcia claims that in October 1995 his son, Silvario, used his debit card to buy a $49.99, one-year subscription to Xbox Live"

That right there is enough to call this BS.

Ok.... it's fun to poke fingers at M$ at every turn...
....but a class action lawsuit for a $35 late fee for one guy?

Kind of a lame. Please

That 1995 date just doesn't add up. Either this is bogus, or its real shoddy journalism. As far as I remeber, the original xbox did not launch until 2000 or so, and live did not start for a few years after that.

I'm taking the wait and see stance here.

It won't go anywhere. MS will send him a check for $35 in the end cause they'll pay more than that in lawyers.

You're informed a the time that it automatically renews, and they send you reminder emails about it. Had he not been a dumbass, he would have bought junior a year membership card at the store.

Unless the courts are willing to dictate that every single online transaction must include faxed identification and a confirmation phone call, this "lawsuit" is dead.

They've edited the date to 2005.

I used to work on the phone for MSN and Xbox Live... in xbox 90% of the calls were parents mad at their kids for using their credit cards.

The funniest ever was a mother from California who called right when we opened at 9am EST (so 6am her time) and found not only the 4 accounts that she got billed for, but 12 more set to bill over the next month (yay for 2 month free trial accounts). She was also rather unimpressed when she asked for the account names (think typical teenage boy fantasy names).

She didn't actually cancel them with me, she was too busy screaming her son out of bed. I presume she called back later though.
