Default bad seller, bad disc, what to do?

hey all, i made a buy for a blu ray movie last week and received it with dirt, dust, finger prints and 2 small scratches on it. i notified the seller right away of this matter and told them i would clean it and see if it worked ok.

well i got around to try watching it with the wife today and from the very start it was skipping, blocking up and the sound was cutting out. i emailed the seller and they told me quoted from my pm account below in bold letters:

Here's what I'm going to do, let you decide;

Please return the disc, and it if plays perfectly on my same player as before I sent it to you w/o issue I'll refund every penny to you, and shipping both ways.

If it does not, the damage was done at your end, and no refund will be issued in any way.

I hate to be this way, but this disc played perfectly three times on three different players w/o issue since it was new. I don't do buyers remorse, as I'm not a retail outlet


now what am i suppose to do here? why would i put a scratch on a disc i bought for my wife to keep? i am very tempted to leave negative feedback for this. i have had may great trades and buys so far with no incident, now this

so now i am wondering if i mail it back i guess i lose my money and the movie? i cant believe how bad the scratch is also, it is down into the disc bad, so for sure it will skip.

anyone have any suugestions and how ppl can get away with this kind of behavior. any thought on what to do?
