Yeah but those are supposed to be with a new pc not upgrading the o/s on an existing one

I think that system builder license also applies to system refurbishers. As long as you provide support to your customer, you can install it on existing hardware. The existing OS license on the computer becomes void. The new license is tied to the hardware and cannot be installed on another machine. I'm sure the XP EULA was written this way, haven't read the win7 license.

OEM Licence are cheaper because you can't have support from the Microsoft Help Lines. Try calling them with a OEM and they'll tell you to contact you're manifacturer or retailer, they won't help you. Support at microsoft cost a LOT of money. I work in a small entreprise and MS charge 750$ for a support call for Windows Server 2008 on OEM. If they weren't legal, thrust me Newegg.com and all other big internet reseller wouldn't sell them. MS is pretty tight on this. |

Also you can get a free .edu email from http://mail.australia.edu/userhome/login/ I made a account for a friend and was able to Buy Windows 7 with it for him and installed just fine (it does take awhile for them to approve your account so if you need it right away best to find someone in the family or friend with a school email with .edu to help you out to buy a copy. I firmly believe it is legal to sell OEM with any computer hardware, including a $2 computer cable. It might not be what Microsoft wants, but it's still legal. Otherwise, all retailers selling OEMs are opening themselves up to a lot of legal risk selling them in a non pre-installed state. I remember the first time I bought OEM (with a $2 cable), one worker didn't think I could but the other informed him that any concurrent computer-related hardware purchase legitimized the sale. If you don't need the extras, OEM is the place to be.

No.
OEM License compared to full retail is not transferable like the full retail is. Meaning if you put it on a computer it stays with that computer forever, and can't legally be put on any other machine even if you got a new computer (not with windows assuming). Full retail from Bestbuy can be legally transferred to another machine. That is the biggest difference between the 2. |

I had recently upgrade my Windows XP SP2 to Window7. The system is really nice and faster then any other windows. I think you can order online which is one of the best choice now a days. I suggest you not to upgrade instead format the whole partition and install the fresh it will give you better performance.
