Max Payne is a video game film. It is not "close enough".

Re-Edited list:

I'd also put the DTV Next Avengers and Justice League: New Frontier high on the list.

Batman: Gotham Knight was mediocre like the Dark Knight film. Didn't see The Spirit yet. So can't judge it.
