They look like upscales because Max is not done updating the streaming masters. A lot of titles have the 4K Dolby Vision Dolby Atmos notice on the page but are still the HD SDR versions like Halloween Kills. Others have the Dolby Vision badge but are applying DV to the HD stream like Casablanca and The Wizard of Oz.

Titles that have the 4K Dolby Vision or 4K UHD badges (next to the runtime) have been fully updated. Note that the 4K UHD badged titles are SDR so again, a DV/HDR layer added by the AppleTV.

Warner Discovery needs to be bombarded with requests for Range Matching to fix this.

I also tried the XBox app and it only supports HDR10. But once a stream triggers HDR10 then it stays stuck in HDR forcing that over the image.
