I think this guy is a moron. Cover clearly states that it's only for copies sold at full retail price aka new http://www.gamestop.com/Catalog/PopB...oduct_ID=72892

The warning is there including the expiration date so he would be full aware of it but chose to ignore the simple rules on the back cover. It's his own fault and stupidity. Plus there's no way to just hide that since it's right there on the cover. I guess we just need our products to be idiot-proof.

I may not like Gamestop but I hope this guy loses. This is even more stupid than that lady winning the lawsuit with McDonald's just because she spilled coffee on herself which was an epic fail on his part not McDonald's since if you drink coffee, it's obviously going to be hot and should always be careful and not careless unless you have it sit for like half an hour before drinking or put in some creamer in it to cool it down. Plus the warning was right on the cup. Plus when you're at that age, your body can get bruised and also burned easier than when you're younger so got to be more even careful. Sure it was hotter than supposed to be but that's what the warning is for.

People will do anything to get money from big corporations. Such a sad, sad world we live in.

I don't feel bad for this guy. Every gamer knows about Game Stop's unethical (possibly illegal) practices. The last time I bought ANYTHING from them was the Metal Gear Solid IV limited edition like 3 years ago, and that was because it was a Gamp Stop exclusive.

Many games can be bought when on sale at Amazon.com new for less that Game Stop charges for used games. About 95% of my games come from Amazon.

If people want to keep wasting their money doing business with Game Stop it's their own fault.

I've yet to see anyone even remotely come close to proving how their practices are 'possibly illegal' or even really unethical.

They do business, just because you don't agree with the business that they do, it doesn't make it 'unethical' it just means that you disagree with the business that they do.

It's not random people on the internet. I've experienced their practices first-hand and have friends who once worked there. Not only do I hear their stories, but they also have pictures/video they took of things that went on behind closed doors.

I knew about that stuff for years. My friend had cell phone pics and video showing "new" game consoles like 360's and PS3's being stored in the men's room laying on a filthy floor with dryed urine on it. There was even some dryed feces on a few of the boxes. But hey, what do I know? I'm just "some random guy on the internet." Just remember that when you wipe off a mysterious brown stain from your next purchase at Game Stop.

Look around on the internet or just ask people and you'll realize it's more than just a few people spouting off lies about that company. Nearly every ex-employee and countless former shoppers will tell you these kind of nightmare stories.

I don't shop at gamestop, but I've still yet to hear any evidence from someone who isn't a random person from the internet.

I wasn't aware until this thread that so much bad stuff went on at GameStop. I can honestly say I've never had a bad experience there. I don't exactly spend a ton of money there, but the customer service has always been good for me. I've never bought a "new" game where I've seen them put the disc in the case. I'm not saying that their used prices are the best, or that I've never been duped into buying a used game as new, but at least I never knew of it happening.

Glad for you if that is the case. You must have lucked out. Check out some of mikejet's links above or just try an internet search for Gamestop class action lawsuits and you'll see how widespread Gamestop's issues are.

Yes they have issues and have had issues in the past. But I think most of us can agree it has nothing to do with the current suit filed and that the current suit is just plain ridiculous.
I donot blame the compnay for selling used games for $5 less than new I blame the idiots that buy them at that price. And as to the fact that they did not get downlaodable content and to claim that not having it made the game unplayable. So I guess after april 30 of this year when the downloadable content is not longer free to those that bought the game new it would be unplayable. This suit is all about a sue happy society and someone wanting to try and get a quick buck. The sad part is will it be cheaper for the company to settle the suit than to fight it. And set another wonderful president for the legal system.

I've never been a huge fan of Gamestop and very rarely shop there, but if you buy a preowned/preplayed game with the expectation that every "part" of it will be unused, I have zero sympathy if that doesn't turn out to be the case....it is called used for a reason...and sucks the guy couldn't return it, but it's not Gamestop's problem the guy waited as long as he did to try the downloadable content...their return/exchange period is made very clear when you buy something

He should have known that used games do include everything but (regardless of what it says on the package) if he asked a store clerk and that clerk said otherwise, it's up to that store to either fulfill what they told him or give him a full refund.

Chances are the store and employee will lie about it so it becomes his word against the stores and the court will side with the store.

.....I so hate our $%^&ed up legal system.

Also.......the woman who sued McD for the hot coffee sued because it gave her 3rd degree burns. Coffee should never be that hot. Her suit was not as frivolous as most people think.

Where in the story does it say the guy asked a store employee if it came with the content (or were you just saying that as a scenario?)? If he did ask someone and they gave him wrong information, then yes, I would agree the store is partly to blame and at the very least should offer him a refund. But based on what we've been given:

I'm not so much trying to side with Gamestop here as I am going against a guy who should have known better and the fact that he is suing them because of his own poor decision making seems pathetic (to me ).

Okay...I could have sworn when I first read the story, he checked with a clerk and the clerk said it would come with that content available.
