Warner chooses to tailor the peak and average for HD DVD. Disney doesn't.

In fact, it may not be necessary to have such a high bitrate. That is the same quality might be achievable at a lower bit-rate. But, why bother finding that optimal spot if you have the bandwidth and capacity to play with?

The cost of a VC-1 encode is related to how much segment re-encoding work is necessary. And a wide open pipe probably reduces that considerably.

It could also be partially political. Disney is showing spectacular results with VC-1, but at high bitrates totally unachievable by HD DVD.
