The agents operate on the same basic rules as real world humans to be realistic (so they don't make themselves too noticeable within the matrix). As Morpheus says: some rules can be bent. Only those that have "freed their mind" learn they can operate outside of earthly rules. That's what the whole "there IS no spoon" bit is about. Once you realize none of it's real, you can manipulate it with your mind.

Neo dives into the agent because he realizes the agent is only a perceptual representation of data. Up to that point, Smith uses "physical" contact to attack. After that point - in the other movies - he too uses the 'infection' method, not to destroy but to corrupt the data and imprint his own code, thereby copying himself.

Up to the end scene in the first flic, smith is just a program running to serve the needs of the matrix - and he must work withig the confines of what he is allowed to due based on his programming. But he learns from neo, and he is changed in the process, and begins to also start bending the rules.
