Default Xbox Live Experience...is it really this bad?

My brother just got his Xbox (bought him one from a friend, who rarely used it. It has never been opened or tampered with).

Created a gamer tag. I thought it would be kinda neat to use "XboxRROD".

It worked, and he was signed up for a silver account. We then upgraded his account to gold status buying Xbox Live for 3 months.

When updated the information on the Xbox, and when it logs us in, it says "you have new messages that must be read"

"You have been suspended until 12/31/9999

Logged in to xbox.com. No reason in either emails. I am just confused.

Did you set the correct date on the Xbox console. I know there was once an issue with that.

Wow that's crazy. I've been on XBOX Live since 05 and never had a problem with it. Are you using a modded XBOX?

I doubt it. Xbox isn't petty like that. I think either he has a modded box or the previous owner was banned and somehow the box is tagged. Either way, call Xbox support.

If it says you have been suspended until 12-31-9999, then you need to turn the parental controls on your 360 off... I migrated my NickfaT account to my 360 for the hell of it, and then tried to sign onto my original Xbox, but it wouldn't work. So I turned the parental controls off on my 360 and it let me sign on.
found that on a forum. but it sounds to me like you're using a modded xbox

PSN does the same thing, I remember somebody asking this question. I don't think the actual dollar is ever charged to your card permanately. It has something to do with them testing the card, then they run the real transaction through, then they refund the dollar. I forget why they do this though.

No... they don't suspend your account for a gamertag, they just force you to pick a new one before you are allowed to sign on. Been there done that.

What they OP is experiencing is a console ban. In the past MS would just ban individual user accounts of modders and hackers, but that didn't really help the situation as they could just create a new account and get right back on. So with the 360, MS wisely applied the ban to the modded console itself to insure that it could never sign back in to XBL. MOST of these bans are correct, but A FEW consoles have been banned erroneously. Call MS to find out why the console has been banned. It may be neccessary to send the console in to determine whether or not it has ever been actually modded.

There are some gamertags that are blocked from ever being formed. If you are actually able to make a gamertag, then it can be banned anytime in the future if an XBL member finds it offensive and files a complaint about it.
